SPANGLER RE: RESUBDIVISI©N OF BEDROS PROPERTY AT 645 UPLAND ROAD. Communication
in which Mrs. Spangler protested the recent approval of Planning Commission recommenda-
tion to allow resubdivision of portion of Lot 3, Block 18, Oak Knoll Manor into two lots
was read by Clerk. Mrs. Spangler further stated that she had specifically requested that
she be notified of any matters coming before the Planning Commission or the City Council
which might effect her neighborhood. Protestant asked for a reconsideration of the action
taken in the matter claiming a traffic problem was present due to steep driveway serving
two lots into narrow blind curve in Upland Road. She also protested splitting front
footage of a ?5 foot lot in two. City Engineer advised the single driveway appeared to
be the best solution of the problem. The contractor intends to build a home for himself
and will set the building back 30 or 35 feet from the road. Councilman Royer called atten-
tion to the three conditions under which resubdivision was allowed, namely:
1. Owner pay for sewer lateral.
2. Provide access easement to both lots.
3. Provide minimum of 25 foot frontage on street for second lot.
City Attorney advised no action changing the present situation was possible other than
adding additional conditions. Setbacks can be changed. Councilman Britschgi suggested
that Building Inspector withhold permit until Council can examine plans and approve or
disapprove. Councilman Britschgi so moved, seconded by Councilman Stout. Mayor Herkner
asked whether provisions might be made to notify property owners of intended resubdivisions.
City Attorney stated such a provision would necessitate amendment of the Subdivision ord-
inance. Motion carried.
