Councilman Royer stated his opinion that the Planning <br /> Comm might be asked to mail notices in cases where there is a possibility of a pro- <br /> test or in cases where lots are less than the required sizes. Councilman Royer then moved <br /> that the City Attorney bring back a recommendation covering unusual conditions in line with <br /> the above suggestion. Motion seconded by Councilman Stout and carried, Councilman Granger <br /> voting NO. <br /> INTRODUCE ORDINANCE REZONE AREA PINE AND STAMBAUGH FROM R -3 to R -4. This will include Lots 1, <br /> 2, 3, 4, 9, 10, 11 and 12, Block 51 Eastern Addition. Planning Commission initiated and <br /> and recommended the rezoning it being their contention such rezoning would be in the pub- <br /> lic interest. Councilman Spillers moved introduction of ordinance, seconded by Councilman <br /> Granger and carried on roll call. <br /> INTRODUCE ORDINANCE FIRE ZONE #2, SAME AREA. Councilman Jones offered Ordinance for introduc- <br /> tion, on recommendation of Fire Chief, seconded by Councilman Spillers and carried. <br /> INTRODUCE ORDINANCE REZONE LOT 2, BLOCK 17, REDWOOD HIGHLANDS (Herman) CORNER ELWOOD AND BROAD- <br /> WAY. Councilman Britschgi suggested that more consideration be given this subject before <br /> voting. He read from the minutes of May 2 in which he stated that he reserved the right <br /> to vote against the ordinance under certain conditions. It was the understanding of Coun- <br /> cilman Britschgi that attorneys are attempting to come to an agreement and the Council <br /> should wait before introducing the ordinance and have the attorneys present the Council <br /> with a complete picture of the project. City Attorney advised the Council that the attor- <br /> neys are to prepare a declaration of restrictions as set forth at the public hearing. Coup- <br /> cilman Britschgi moved that this be placed on the Agenda for May 16th, City Attorney to con - <br /> tact Mr. Dell'Ergo, seconded by Councilman Jones. Councilman Granger suggested that there <br /> be included in the motion request for written statement of Mr. Dell'Ergo to substantiate his <br /> statement that the rezoning would benefit the people in the neighborhood. This was agreed <br /> upon by the maker of the motion and the second. Motion carried. <br /> INTRODUCE ORDINANCE REZONE AREA BOUNDED BY CAMINO, CENTER, LINDEN AND WOODSIDE ROAD FROM <br /> R -1, 2, 3, and 4 TO C- 1 -H -F. ,Councilman Royer offered Ordinance for introduction, seconded <br /> by Councilman Spillers and carried. <br /> RESOLUTION ESTABLISH MINIMUM WAGE SCALE PARKING DISTRICT NO. 1. City Attorney Currie advised <br /> the Council that this is fixing the minimum wage scale as set forth in the specifications <br /> for this project. Councilman Britschgi offered RESOLUTION 1870 and moved adoption, second- <br /> ed by Councilman Stout and carried on roll call. <br /> REFERRING BACK TO PROPOSED EXTENSION OF BREEZE PLACE, City Attorney requested the adoption of a <br /> resolution transferring $3,300.00 for the acquisition of property owned by Mr. Duke, as a <br /> result of his discussion with Mr. Duke. Councilman Royer offered RESOLUTION 1871 and moved <br /> adoption, seconded by Councilman Spillers and carried on roll call. City Attorney advised <br /> II the Council that a condition should be established including the acquisition of property <br /> in the immediate vicinity by Mr. Duke, also that the records indicate that connection to <br /> existing facilities be allowed subject to posting of a bond as previously agreed upon. <br /> After discussion as to the amount of bond, Councilman Spillers moved that a bond of <br /> $1,000.00 be accepted, seconded by Councilman Royer and carried. <br />
