7. 00-3 <br />Avondale Avenue is rezoned from R -1 to high intensity commercial zoning, and if the <br />proposed project is not built or sold off to another developer, then a different project could <br />be built with commercial structures in the rear, adjacent to the residential area. As a <br />response to this concern, the developer agreed to file a deed restriction for 20 Avondale <br />Avenue that would essentially prevent any structures from being built on this rear portion of <br />the site (except for at -grade parking, landscaping, and minor structures such as trash <br />enclosures). This restriction would 'run with the land" and would pertain to any future <br />development on the site. A copy of the draft Deed Restriction for 20 Avondale Avenue is <br />included in Attachment #4. Staff believes that such a deed restriction is a good solution to <br />preventing commercial structures from getting too close to the adjoining residential <br />neighborhood. <br />Planning Commission Action <br />In addition to recommending the General Plan and Zoning Map Amendments at the June <br />4, 2002 meeting, the Planning Commission also took the following actions: 1) approved a <br />Mitigated Negative Declaration associated with the project and the General Plan and <br />Zoning Map Amendments; 2) approved a Planned Development Permit for the proposed <br />project; and 3) recommended approval of a Variance and a Use Permit to the Zoning <br />Administrator for other entitlements related to the proposed project. The project approvals <br />granted by the Planning Commission are contingent upon the proposed General Plan and <br />Zoning Map Amendments. <br />Alternative <br />Deny the General Plan and Zoning Map Amendments for 20 Avondale Avenue. <br />Fiscal Impact <br />Amending the General Plan and Zoning Map for 20 Avondale will allow comprehensive <br />redevelopment of the subject property coordinated with the existing adjacent parcel at 150 <br />El Camino Real.
