<br />ß,'ß -3~ <br /> <br />Highland Avenue, is improved to City standards. Beyond that portion, <br /> <br />another portion is paved to a width of approximately 20 feet (or, one-half <br /> <br />that of a standard hillside street width). The remaining portion of Laurel <br /> <br />Way, extending westerly and then northerly is unimproved and allows <br /> <br />passage for but a single vehicle at a time. <br /> <br />Except for that portion <br /> <br />improved to City standards, Laurel Way is a private road (including that <br /> <br />portion paved to a one-half width of a standard street). <br /> <br />b. Laurel Way is located on uneven, steep terrain. The average slopes of <br /> <br />undeveloped lots fronting on Laurel Way range from 21 percent to 64 <br /> <br />percent. <br /> <br />c. A plat of Laurel Way, showing improved and unimproved lots fronting <br /> <br />thereon, is attached hereto, marked Exhibit "A," and by this reference <br /> <br />incorporated herein. References herein to street numbers correspond to <br /> <br />the lots so numbered on Exhibit A. References herein to street surface <br /> <br />condition correspond to the three sections labeled on Exhibit A, <br /> <br />specifically "Unpaved," "Substandard Paved," and "City Standard Paved." <br /> <br />d. In 1971, assessment district proceedings were instituted for the <br /> <br />improvement of Laurel Way. Those proceeding were terminated upon <br /> <br />opposition by some of the landowners to be assessed. Pursuant to those <br /> <br />proceedings, plans for the construction of street and associated utility <br /> <br />improvements were prepared entitled, "Laurel Way Improvement Unit No. <br /> <br />2," dated 9/13/71 (the "Improvement Plans"), which Plans are on file in the <br /> <br />office of the City Engineer. <br /> <br />Atty/Reso/Reso.1520 <br />022205 <br /> <br />2 <br />
