<br />'7, A -3 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the Ci Mana er <br /> <br />February 28, 2005 <br /> <br />Subject <br />Appeal of the Zoning Administrator's approval of a Use Permit and Architectural Permit at <br />2325 Euclid Avenue to allow for the installation of a wireless telecommunications facility. <br /> <br />Recommendation <br />That the City Council uphold the Zoning Administrator decision and based on a review of <br />the staff report, administrative record and public testimony find that: <br /> <br />1. The placement of the subject facilities, as conditioned by the Use Permit and <br />Architectural Permit, will meet the requirements of Redwood City Zoning Ordinance <br />Article 38, including but not limited to, operation and maintenance; height; setbacks; <br />distance; area; color; and screening. <br /> <br />2. The subject facilities will comply with the radiation requirements established by the <br />Federal Communications Commission (FCC) and that the City is preempted by <br />Federal law from regulating the placement of such facilities that comply with FCC <br />regulations related to radiation. <br /> <br />3. Conditions contained in Use Permit 62-01 and Architectural Permit 63-01 are limited <br />to Verizon, Inc. and do not extend to the subject application. <br /> <br />Background <br />Previous Verizon Application: <br />On February 20, 2003, the City issued a Use Permit (UP 62-01) and Architectural Permit <br />(AP63-01) to allow for the installation of 12 wireless communication antennas in an <br />enclosure on the roof of the First Congregational Church. The application also included <br />the installation of ground level equipment within an enclosure to be constructed adjacent to <br />the church. This previous application went through a series of public hearings and <br />community meetings. During the application review process the church publicly stated, in <br />response to concerns from several neighbors, that they did not anticipate future <br />commercial activities at the site. The City's approval of this project was documented in a <br />Notice of Official Action (dated February 20, 2003) which incorporated seventeen (17) <br />conditions of approval with the intent of mitigating potential noise, aesthetic, and <br />operational impacts. (Please refer to the Notice of Official Action dated February 20, 2003, <br />Attachment #1 ). <br /> <br />Current AT&T Application: <br />On September 8,2004, the Alaris Group on behalf of AT&T Wireless applied for a Use <br />Permit (UP2004-84) and Architectural Permit (AP2004-114)to allow for the installation of a <br />second wireless telecommunications facility at the First Congregational Church. The <br />application included the installation of six (6) panel antennas mounted inside a new steeple <br /> <br />2/28/05 <br /> <br />3 <br />
