<br />f,A--Lf <br /> <br />to be constructed on top of the church building. Three (3) equipment cabinets would be <br />located within a new equipment enclosure. <br /> <br />The proposed application was reviewed by the Architectural .Review Committee on <br />Tuesday, October 26, 2004. The Zoning Administrator considered the application at a <br />Public Hearing held on Wednesday, October 27,2004. The project was approved by the <br />Zoning Administrator and documented in a Notice of Official Action on November 5,2004. <br />The Notice of Official Action incorporated nineteen (19) conditions of approval that are <br />intended to mitigate potential noise, aesthetic and operational impacts. (Please refer to the <br />Notice of Official Action dated November 5,2004, Attachment #2). <br /> <br />Use Permits for Wireless Communications Facilities <br />The purpose of the City's regulations for Wireless Communication Facilities as stated in <br />Article 38 of the Redwood City Zoning Ordinance is to allow facilities which provide for the <br />personal communications needs of residents of the City and region, and of local business <br />and government, while minimizing adverse visual and operational effects of such facilities <br />through appropriate design, siting, and screening. <br /> <br />Where appropriate, the City encourages the co-location of facilities and/or consolidation of <br />facilities at one site, provided the cumulative impacts do not create adverse aesthetic or <br />operational impacts. Through the incorporation of conditions of approval, the Zoning <br />Administrator in consultation with the Architectural Review Committee was able to mitigate <br />the potential noise, aesthetic and operational impacts. The placement of equipment <br />cabinets within an enclosure will minimize the noise and vibration generated from such <br />equipment as well as obscure any visual impacts associated with the equipment. The <br />antennas will be mounted on top of the church roof within a steeple enclosure that has <br />been designed to be architecturally compatible with the existing church. The placement of <br />the subject facilities, as conditioned by the Use Permit, meet the requirements of the <br />.Redwood City Zoning Ordinance Article 38. <br /> <br />The proposed radiation levels are well within the allowable limits as set by the FCC per the <br />applicant's .Radio Frequency ".RF" report (which includes both the existing wireless facilities <br />as well as the proposed). Radiation associated with these types of installations is subject to <br />review by the F.C.C, and not the City of .Redwood City.. Conditions related to radiation are <br />provided to ensure that the public has access to this information; however, it is not the <br />City's responsibility to enforce the F.C.C's regulations. <br /> <br />Appellant's Issues <br />On November 12, 2004, Mary Browne and Gerald Nagel (in conjunction with additional <br />neighbors) appealed the decision of the Zoning Administrator. (Please refer to Attachment <br />#3, appeal letters). The appellants are concerned about the placement of an additional <br />wireless telecommunication facility at the church property. The appellant has cited that the <br />proposed application "violates a contract" and represents additional health concerns <br />stemming from the radiation associated with the proposed use. <br /> <br />Analysis <br />The following analysis considers the findings as referenced in the November 5, 2004 <br />Notice of Official Action with respect to the subject property and proposed project.
