On May 22, <br /> 2000 the City Council voted to give Eddie's Adult Bookstore a five year amortization extension <br /> commencing from the date that ordinance No. 1130.298 went into effect, which is approximately June 22, <br /> 2000. <br /> In response to the three points addressed in Article 27.5 D of the Redwood City Zoning Ordinance. <br /> 1. The applicant has made a substantial investment (including but noP limited to lease obligations) in the <br /> property or structure on or in which the nonconforming use is conducted; such property or structure cannot <br /> ,•eadilv be converted to another use; and such investmenr was made prior to the effective date of the <br /> dinance adding this Section to Article Z7; <br /> Our use can not readily be converted to another use and the extent of our investment includes, but is not <br /> limited to, the following: � <br /> • Our lease expires on December 31 2005. In the event of an early termination of the lease we are <br /> liaele to the Lessor for penalties for early termina�tion. <br /> • A considerable ir�vestment has been made building and maintaining the current customer base <br /> through arivertising, promotional campaigns, interior decorations, up and the value of our <br /> current inventory. <br /> • We have a proven gross income and the loss of future potential income would be devastating. <br /> � Our business property consists af store fixtures, counters, computer equipment and arcade <br /> equipment. Our arcade system includes a computerized operating system, monitors, DVD players � <br /> and bill acceptors. We face additional losses in trying to dismantle this system for future use. <br /> Converting to another use is not readily available and would create a financial loss and extreme hardship. <br /> �. The applicant will be unable to recoup said investment as of the date established for.termination of the <br /> rrse; <br /> Converting to another use (and/or relocation prior to the date established for termination, which is <br /> approximately June 22, 2005, would not allow us to recoup our enormous financial investment in our <br /> basiness. <br /> �'he applicant has made good faith efforts to recoup the investment and to relocate the use to a location in <br /> . �nformance with Section 27.3 <br />
