8 � (�- <br /> ➢ A non-conforming use shall not be reestablished in any structure in a <br /> residential zoning district if such non-conforming use has ceased for a six (6) <br /> consecutive month period. <br /> ➢ A non-conforming use shall not be reestablished in any structure in a <br /> nonresidential zoning district if such non-confortning use has ceased for a <br /> twelve (12) consecutive month period. <br /> ➢ In the event of a non-conforming use of land not involving any structure other <br /> than fences and structures or buildings of less than four hundred (400) <br /> square feet in area, the non-conforming use shall not be reestablished if such <br /> non-conforming use has ceased for a period of ninety (90) consecutive <br /> days. <br /> 2. Proposed Revised Amendments to the Zoning Ordinance (Section 33.16a) <br /> regarding Non•conforming Parking — Single-Family Residential (a single-family <br /> use or structure that is non-conforming). <br /> Mr. Williams said that at the provisions in the Draft Ordinance allowed for expansion <br /> or enlargement of single-family home that does not have adequate parking, subject <br /> to the condition that it could not exceed 2,000 square feet. He said that the <br /> Commission asked staff to look at some ways to provide some flexibility to do that <br /> The following is the proposed language: <br /> Provision 4 (proposed revision) <br /> The structure will not exceed two thousand (2,000) square feet in total living area <br /> after the enlargemen4 is completed, exceot as orovided in Provision 71 below: <br /> Provision 7 (proposed addition) <br /> The square footage limitation of 2,000 square feet may be exceeded where a Use <br /> Permit is approved, subject to meeting the following criteria: <br /> a. That the single-family dwelling property will have no more than three (3) <br /> bedrooms after the enlargement. <br /> b. That the enlargement not be intended for use as or conversion to a bedroom or <br /> used for sleeping purposes. <br /> c. That acceptable enlargements be limited to kitchen enlargement, bathroom <br /> additions and appurtenant utility/service areas and storage. <br /> d. That the total net enlargement will not exceed 200 square feet (gross). <br /> e. That the total net enlargement will not cause any reconfiguration of the uses of <br /> the rooms in the dwelling as used prior to the enlargement. <br /> f. That the enlargement be considered a one-time occurrence over the life of the <br /> subject property (unless the regulations change or as otherwise provided in the <br /> Zoning Ordinance). <br /> Page 2 of 7 <br />
