If City conclusively determines that such restoration <br /> or replacement is economically or practicably infeasible, City may terminate this <br /> Agreement. If the repair or restoration pertains to City-owned facilities and City <br /> determines that the cost of restoration or replacement is economically or <br /> practicably infeasible, City may likewise terminate this Agreement. <br /> 6.8 Interruptions in Supplv <br /> SBSA will operate the Treatment Plant and Recycled Water Facilities with the <br /> objective of providing a continuous supply of Recycled Water to City at the <br /> production rate defined in Attachment Ten and illustrated in Attachment Eight. <br /> The Parties recognize that both scheduled maintenance and unexpected <br /> emergencies may occasionally interrupt delivery of Recycled Water. City will be <br /> responsible for metering and recordkeeping of potable water introduced by City <br /> into its storage tank for use during both types of interruptions. <br /> • Scheduled Interruptions <br /> SBSA will schedule maintenance-related interruptions to take place during the <br /> low-demand months (November through March) whenever possible. SBSA will <br /> notify City at least 10 days in advance of any planned interruption, providing <br /> information about the reason for the interruption and the dates the interruption is <br /> scheduled to begin and end. SBSA will accommodate to the maximum extent <br /> feasible requests by City to postpone or reschedule the interruption. SBSA will <br /> make all reasonable efforts to limit both the frequency and duration of planned <br /> interruptions in supply. SBSA will provide City periodic reports during the <br /> planned interruption on the progress of the repairs or upgrades to facilities that <br /> necessitated the interruption. <br /> -14- 1091374.7 <br />
