The Permittee wil! either provide fandscaping to screen <br /> the condenser per City approval or contribute to a landscaping #und to the City fior <br /> purposes of installing iandscaping within the easemen#. <br /> 6. Maintenance. Permittee agrees to maintain the condenser unit in a clean <br /> and good working order; and the encroachment area clean, clear, and free of debris <br /> and overgrown vegetation at Permittee's sole cost and expense. <br /> 7. Hold Harmless: Release. Permittee shall be solely responsible and <br /> liable for all damages to persons or prape►'ty, including injury tc os- death 3�, �ersor�s <br /> and loss of use af property, due directly or indirectly to Permittee's use and occupancy <br /> of the easement and shall defend, indemnify and hold City, its Councit, officers, boards, <br /> commissions, agents, empioyees and volunteers harmless from any and all suits, <br /> actions, damages, or claims to which Ci#y may be subjecfed by reason of said use and <br /> occupancy af the City easement hereunder. <br /> 8. Insurance. Permittee shall maintain at all times during which this permit <br /> remains in effect, at Permittee's sols cost and expense, commercia! general liability and <br /> property damage insurance, which insurance shall be in the fotlowing minimum <br /> amounts: <br /> ta) $1,000,000 for injury or death of any one person and $1,000,000 for <br /> any one occurrence; <br /> (b) Property damage insurance in the amount af$1,OOO,Q00 <br /> A certificate or certificates evidencing the maintenance of the required <br /> insurance or program of self-insurance shall be deposited with the City Clerk prior to <br /> Atty/Permits/20a8.020 3 <br /> 092906 <br />
