Permit fees for accessory dwellings are routinely in the $5,000 <br /> __ range'. <br /> ARTICLE 41: AMENDMENTS <br /> An�cle 41 of the Zoning ��rdinance outlines the process for amending the Zoning <br /> Ord�nance. Currently, Se�tion 41.2 states that zoning amendments can onlv be <br /> initiated by "resolution of intentions of the Council, resolution of intention of the <br /> Commission, or application of one or more owners of record of property affected <br /> by the proposed amendmenY'. No where does it permit City sfaff to initiate the <br /> changes. For this reason, the Planning Commission has had to adopt a <br /> resolution of intention for all recent changes to the zoning ordinance even if <br /> initiated by staff (In fact, the Commission needs to adopt another resolution of <br /> intention before it can even open the public hearing on the subject amendments.) <br /> This proposed change would allow staff to also initiate amendments to the <br /> Zoning Ordinance. Staff would initiate amendment proceedings by just preparing <br /> a staff report with a recommendation. The Planning Commission wauld then <br /> review, discuss, hold the public hearing and make a recommertdation to the City <br /> Council. These changes would streamline and generally make it easier for the <br /> City to propose needed amendments. <br /> ENVIRONMENTAL DETERMINATION: <br /> State Guidelines for the California Environmental Quality Act (CEQA) provide a <br /> Categorical Exemption (Class 5, Section 15305 of the Guidelines) for: <br /> "minor alterations to land use limitations...that do not result in changes <br /> inland use or density" <br /> The above amendments are exempt under this classification as all of the <br /> proposed revisions comprise minor alterations to limitations outlined in the <br /> Zoning Ordinance, and no changes in land use or density are proposed. Also <br /> note that accessory dwellings are specifically exempt from CEQA. <br /> ATTACHMENTS <br /> 1.
