<br />¿fA- /3 <br /> <br />33. The applicant shall obtain a Building Permit prior to the commencement of <br />construction. <br /> <br />34. At least one month prior to occupancy, the applicant shall introduce the <br />school via a courtesy notice to property and business owners in the lower <br />Broadway neighborhood. In addition to information about the school <br />curriculum and any marketing information that the school wishes to include, <br />the notice shall explain the hours and purpose of the curb-side pick-up and <br />drop-off zones along the Broadway and Charter Street frontages. City staff <br />will provide mailing labels to the applicant for this purpose. <br /> <br />.' <br /> <br />35. In the event that the use is determined to be detrimental to the public health, <br />safety, peace, morals, comfort, or general welfare of persons residing or <br />working in the neighborhood, adjacent properties and improvements, or the <br />general welfare of the city, the Use Permit shall be subject to a new reyiew <br />by the Zoning Administrator at a public hearing. <br /> <br />Where a Use Permit has not been used within one (1) year from the date of <br />granting, either by beginning of construction of the improvements or by the <br />initiation of the activity which is the subject of the Use Permit, said Permit shall <br />automatically terminate and be of no further effect. <br /> <br />If approved, no building or zoning permit shall be issued, and no use shall be <br />established except in accordance with and subject to the terms and conditions <br />outlined above, and in no case shall such permit be issued or use established <br />prior to the final action on any appeals that may be filed within the appeal <br />period. Any appeal made in accordance with the provisions of Section 48.2, <br />Ordinance No. 1130 (Zoning Ordinance), must be received by the City Clerk no <br />later than seven calendar days after the date of the official action.
