BFC and/or its contractors shall obtain all permits, and other forms <br />or documentation which are required and forward them to the City Administrator <br />with the required evidence of insurance. <br /> <br /> 16. Notifications. BFC shall, prior to the issuance of an Encroachment <br />Permit or consistent with other provisions of the Encroachment Permit, certify to <br />City that it has provided or will provide written notification of its intent to perform <br />work to the property owners, residents and business operators of all properties <br />adjacent to streets and/or dght(s)-of-way where BFC will be excavating. Unless <br />otherwise agreed by City, said notice, shall be mailed to the property owner as <br />listed on the most recent assessor's tax roll at least seven (7) days pdor to the <br />issuance of an Encroachment Permit, and delivered to the residents and business <br />operators. <br /> <br /> 17. Assiqnment. This Agreement shall not be assignable by BFC without <br />the explicit prior written approval of City, which approval shall not be <br />unreasonably withheld or delayed, provided, however, that BFC may assign the <br />rights granted herein to a parent, successor, subsidiary, joint venturer or affiliate <br />of BFC now or hereinafter existing, by only providing notice to City of such <br />assignment. However, this Agreement shall be binding on successors and <br />assigns and shall be disclosed to assignee.
