5. Contractor may request that Samaritan Training Center withdraw from Contractor's field <br /> intemship experience program, any trainee who Contractor determines is not performing <br /> satisfactorily, or who refuses to follow Contractor's administrative and patient care policies, <br /> procedures, roles and regulations. Such request must be in writing and must include a <br /> statement of the reason or reasons why Contractor desires to have the trainee withdrawn. Upon <br /> receipt of such request Samaritan Training Center shall withdraw said trainee from the <br /> program. <br /> <br />6. Samaritan Training Center shall notify each trainee that he or she is required to: <br /> <br /> a. Follow the administrative and patient care policies, procedures, roles and regulations <br /> of Contractor; <br /> <br /> b. Acquire and use the necessary and appropriate uniforms; <br /> <br /> c. Arrange for personal transportation and personal living accommodations and costs: <br /> d. Arrange health insurance; and <br /> <br /> e. Enter into and abide by a training agreement with contractor. (a sample copy of this <br /> training guideline is attached hereto as an exhibit). <br /> <br />7. Contractor shall maintain complete attendance and progress records and reports on each <br /> trainee's performance and shall provide an evaluation for each trainee to Samaritan Training <br /> Center on forms provided by Samaritan Training Center. <br /> <br />8. Contractor shall, upon reasonable request, permit Samaritan Training Center and/or appropriate <br /> governmental agencies charged with the responsibility of accrediting or approving the <br /> paramedic training program to inspect the Contractor's facilities, services, trainee's records and <br /> such other materials which pertain to the field internship training program. <br /> <br />9. It is expressly agreed and understood by Samaritan Training Center and Contractor that the <br /> trainees under this program are in attendance with Contractor for educational purposes and they <br /> are not considered to be employees of Contractor for any purpose, including but not limited to, <br /> compensation for services, employee welfare and pension benefits, or workers' compensation <br /> insurance. This understanding does not apply to any trainee actually employed by Contractor <br /> who participates in the Samaritan Training Center paramedic training program pursuant to the <br /> terms of a separate agreement between Samaritan Training Center and Contractor whereby <br /> Samaritan Training Center has agreed with Contractor to ~ain selected employees of Contractor <br /> as paramedics. Further it is agreed and understood that the trainees in attendance with <br /> Contractor are not considered to be employees of Samaritan Training Center for any purpose, <br /> including but not limited to, compensation for services, employee welfare and pension benefits. <br /> <br /> 10. It is agreed and understood that the parties to this agreement are independent contractors, that <br /> neither is the employee or employer of the other and that employees of one are not the <br /> employees of the other. <br /> <br /> 11. Samaritan Training Center shall ensure that all students maintain professional liability insurance <br /> coverage (either independently or as an additional insured on School's policy) at minimum of <br /> $1,000,000 per occurrence throughout the course of this Agreement. Further, Samaritan <br /> Training Center agrees to maintain professional and comprehensive general liability insurance at <br /> a minimum of $1,000,000 per occurrence throughout the course of this Agreement and shall <br /> insure instructors who will work at Contractor or require them to maintain professional liability <br /> insurance in amounts as required for students as set forth hereinabove. Further, Samaritan <br /> Training Center shall ensure that such policy provides for notification to Contractor at least 30 <br /> <br /> <br />
