Supplier will not be liable for special, consequential, incidental, exemplary, or <br />indirect damages, including, but not limited to, any loss of anticipated profits, lost <br />savings, or other incidental or consequential damages arising out of City's use or <br />inability to use the Software. <br /> <br /> 4. Customer Support. Supplier shall answer any reasonable technical <br />support request concerning the Software in good faith and upon reasonable <br />efforts during the Warranty Period which is one (1) year from the date of <br />completion. Supplier may not be able to resolve every technical issue or provide <br />solutions to every problem but does premise to make every reasonable attempt <br />to resolve any technical issue and solve every problem. Supplier agrees to <br />provide this support so long as the Software is used and maintained under the <br />conditions and upon the operating System for which it was designed. <br /> <br /> City acknowledges that the System includes software products developed <br /> by third parties. City agrees to comply with the terms and conditions of any <br /> applicable license agreements as set forth by those third parties.
