307 initial request Mr Fales noted that the matter may be referred to staff without impairing Mr. Talt's right to renew his appeal at a later date, if he so desires Dan Talt 365 Lakeview Way, appellant, referred to information pro- vided to staff in his letters of May 26 and June 13 and requested ' an increase of 67% in his water aliocation. Mr Fales explained that his recommendation is that the request for increased alloca- tion be referred to staff for re-evaluation based on the new infor- mation provided by Mr. Talt since he made his original request He po�nted out that it is the desire of Council and staff to be fair in the new situation involving the water emergency and the alloca- tion procedure. Mr. Fales explained further that if, following staff re-evaluatton of the request, Mr Talt �s not satisfied with the decision of the D�rector of Public Works, he may renew his appeal. He noted that staff prefers to consider any request for increased allocation based on all available facts, bearing in mind that an emergency exists (Councilman Bury arrived at 7 46 p.m.) Mr Talt filed with the City Clerk his study of water allocations for his family and those of three neighbors and a letter from Norman East , M.D. relatin9 to the health of Mr Talt's mother. Mr Talt advised he is anxious to meet with staff and discuss his situation with regard to his request for increased water allocation. MOTION Councilman Biagi moved, seconded by Councilman Barrett, to refer to staff for re-evaluation the appeal of Dan Talt, 365 Lakeview Way, from denial by the Director of Public Works of application for � increased water allocation on the basis of the additional �nforma- tion provided by Mr Talt in his ietters of May Z6 and June 13, and that in the event Mr Talt is not satisfied with the further determination of the Director of Public Works, he shall be entitled to an appeal therefrom, without pre�udice. City Clerk Hildebrand reported that the Affidavit of Publication of Notice of Hearing is on file in her office City Manager Fales requested that the public hearing be cont�nued open until the next City Council meeting on June 27, 1977 because certain matters which were expected to be resolved at the time the public hearing was advertised are stili under review by staff.
