Mr. Fales <br /> stated that Council must take action as proposed in the resolution <br /> or not, and City staff can advise whether or not adequate sewage <br /> capacity exists at any given time to accommodate the Council action. <br /> Discussion continued concerning the need to establish priorities for <br /> sewer capacity, the desirab�lity of making property owners aware of <br /> such priorities in order to permit them to plan, the fact that reasons <br /> exist for dtfferent designations on similar properties at various <br /> locations in the City, and the desire of Council to apply a fair <br /> priority system with regard to use of sewage capacity. <br /> City Attorney Schricker advised that legislative action setting <br /> standards and criteria would be necessary to accommodate a system <br /> for parcelling out building�permits, observing that, at present, if <br /> property is properly zoned and all qualifications are met, the <br /> , prospective developer is entitled to a building permit. <br /> The resolution was adopted on the following roll call vote• <br /> Ayes. Councilmen Barrett, Bury, Rhodes, Vega and Mayor Leipzig <br /> Noes• Councilman Norris <br /> Abstained Councilman Biagi <br /> MOTION. Councilman Norris moved that City staff work with the Plan- <br /> ning Commission to review AG zoning based on information provided <br /> by staff for the January 31 seminar, recognizing the lack of economic <br /> viability of some parcels and also to consider some other alternate <br /> zoning which would be appropriate for those parcels. <br /> In response to questions, Mr. Fales advised that the City �s not re- <br /> sponsible for the inadequate provision for future sewage capacity <br /> needs and corronented concerning the sewage capacity problems and the <br /> attempts made by the City to encourage the State to buy 100% of <br /> capacity for certain state-owned lands and the refusal of the State <br /> to do so Mr. Fales noted that the Port put one-half of tts reserves <br /> into an investment in sewage capacity in anticipation of development <br /> of that area, but that the only way greater capacity could have been <br /> obtained for the area of the City west of E1 Camino Real would have <br /> ' been to increase greatly the monthly sewage service cost to the <br /> residents there, which was considered un�ustifiable.
