In further response to <br /> the same request, Chief Building Official Gyselbrecht advised that <br /> the demolition permit was issued as a ministerial act and there was <br /> no legal reason to deny it. <br /> ' Lillian Falk, 217 Encina Avenue, Native Daughters of the Golden West, <br /> spoke in support of the proposal of the Heritage Association as urged <br /> by Mrs Woodhams (see above) <br /> Kathryn Fragulia, 1687 Carleton Court, Peninsula Hills Jr. Women's <br /> Club, urged protection of historic buildings and adoption of an <br /> emergency "90-day stay of demolition" ordinance <br /> City Attorney Schricker advised that the kind of emergencies antici- <br /> pated by the City Charter relate to natural disasters, and observed <br /> that the kind of legislation suggested by speakers with regard to a <br /> demolition stay touches on abridgement of the rights of others whtch <br /> must be protected. <br /> Jeff Rhoads 275 Montalvo, former employee of the City who assisted <br /> in preparation of the draft Historic Landmarks Element of the General <br /> Plan and list of historic sites proposed for State historic designa- <br /> tion, commented on preservation procedures and some successful ventures <br /> in other areas. Mr Rhoads asked that Council offer some direction <br /> in order to indicate City support of historic preservation and spoke <br /> in support of an emergency 90-day stay and an historic preservation <br /> commission <br /> Mrs. Lea Halcrow 44 Duane, suggested that there are federal matching <br /> ' funds which might be available to assist in the purchase of historic <br /> buildings She advised that some banks will make private 90% loans <br /> for properties which are distressed or of historic significance <br /> MOTION Councilman Leipzig moved, seconded by Councilman Chandler, <br /> to approve establishment of an historic preservation commission in <br /> concept and that staff return to Council with a proposal as to <br /> whether the responsibilities should become those of the Civic Cul- <br /> tural Commission or set up otherwise. <br /> Discussion followed in response to Mr. Fales' and Mr. Schricker's <br /> requests for more specific direction with regard to the proposed <br /> staff assignment. It was noted that the proposed approval was for <br /> concept only and that staff might �nvestigate the programs of other <br /> cities and determine what might be possible within the City's <br /> capacity to perform <br /> MOTION WITHDRAWN In response to suggestion of Mayor Barrett, <br /> Councilman Leipzig, with the consent of her second, withdrew her <br /> motion and Mayor Barrett appointed Councilmen Chandler and Rhodes <br /> to a subcommittee to work with the Redwood City Heritage Associa- <br /> tion and to recommend a vehicle to accomplish the goal of preser- <br /> vation and protection of historic structures in the City <br /> In response to question of Mr. Schricker, Mayor Barrett stated that <br /> , it is his intent that City staff would part�cipate also <br /> In response to question regarding any 90-day stay of demolition re- <br /> quirement, City Attorney Schricker advised that all residents must <br /> be treated equally under the law and that any lack of due process <br /> could result in a foundation for creating liabil�ty <br /> (Memo 5/2/78) <br /> Reg Mtg -10- <br /> 5/1/78 <br />
