��9 s � I ' I � i The resolution was adopted as amended unanimously by roll call vote. � (MINUTE ORDER NO 76-209) , i Mr. Halstead reported that another portion of the proposed development i is in unincorporated property and was discussed in the Environmental i Impact Report Mr. Halstead commented on his progress, noting that i LAfCO will consider the property for annexation on August 18 and that ' I there is an application for prezoning in connect�on with it , (The Council recessed from 8 37 to 8 52 p m) Park and Recreation Coimm ssion recommendation re sale of beer and wine in park areas and buildings City Manager Fales referred to his report of July 22, 1976 regarding the sub�ect recommendation and attaching report from the Director of Parks and Recreation, dated July 12, on behalf of the Park and Recreation Commission and a copy of a report from the Commission's Operational Policy Co�nittee dated April 26, 1976 In response to questions regarding legal protection for the City with regard to the required Alcoholic Beverage Commission permit which would be requ�red if beer and wine were to be sold for an event, City Attorney Schricker advised that the Municipal Code contains the provisions for permtts for concessions with which any purveyor must comply, noting that the City �s not a party to the ABC requirement, but that an in- formation sheet is usually provided to those who might wish to use City facilities Mr Schricker advised that the question exists as to how much education of prospect�ve users must be undertaken by the Ctty, observing that such matters can be handled administratively and ' that any activity on public property creates some exposure of the City. Lengthy discussion followed and Director of Parks and Recreation Weeks commented and replied to questions concerning the requirements of permits now, noting that proper licenses would have to be obtained, that use of beer and wine is permitted now but sale is not, that pro- posed regulations on the permitted sale of beer and wine would be con- sidered and reviewed with the assistance of the City Attorney; that methods of determim ng whether a group is charitable and therefore not charged a fee as compared with other groups which must pay a 6% fee will also be discussed with the City Attorney, the possible undesir- ability of permitting the sale of beer and wine at youth events, whether or not such sales might be perm�tted at fund raising events for youth activities but not at the activities themselves, the pro- visions for maintenance and cleanup after events, whether or not and to what extent the Parks and Recreation Department can and should police events, and the fact that it is the responsibility of the Park and Recreation Commission to issue regulations and they have invited policy direction from Council in that area Councilman Norris stated for the record that he opposes changes in present policy which would permit the sale of beer and wine in parks, believing government should not make it easier to obtain alcohol�c beverages , -5- � Reg.Mtg � 7/26/76
