��9 s � I <br /> ' I <br /> � <br /> i <br /> The resolution was adopted as amended unanimously by roll call vote. � <br /> (MINUTE ORDER NO 76-209) , <br /> i <br /> Mr. Halstead reported that another portion of the proposed development i <br /> is in unincorporated property and was discussed in the Environmental i <br /> Impact Report Mr. Halstead commented on his progress, noting that i <br /> LAfCO will consider the property for annexation on August 18 and that ' I <br /> there is an application for prezoning in connect�on with it , <br /> (The Council recessed from 8 37 to 8 52 p m) <br /> Park and Recreation Coimm ssion recommendation <br /> re sale of beer and wine in park areas and buildings <br /> City Manager Fales referred to his report of July 22, 1976 regarding <br /> the sub�ect recommendation and attaching report from the Director of <br /> Parks and Recreation, dated July 12, on behalf of the Park and Recreation <br /> Commission and a copy of a report from the Commission's Operational <br /> Policy Co�nittee dated April 26, 1976 <br /> In response to questions regarding legal protection for the City with <br /> regard to the required Alcoholic Beverage Commission permit which would <br /> be requ�red if beer and wine were to be sold for an event, City Attorney <br /> Schricker advised that the Municipal Code contains the provisions for <br /> permtts for concessions with which any purveyor must comply, noting <br /> that the City �s not a party to the ABC requirement, but that an in- <br /> formation sheet is usually provided to those who might wish to use <br /> City facilities Mr Schricker advised that the question exists as <br /> to how much education of prospect�ve users must be undertaken by the <br /> Ctty, observing that such matters can be handled administratively and ' <br /> that any activity on public property creates some exposure of the City. <br /> Lengthy discussion followed and Director of Parks and Recreation Weeks <br /> commented and replied to questions concerning the requirements of <br /> permits now, noting that proper licenses would have to be obtained, <br /> that use of beer and wine is permitted now but sale is not, that pro- <br /> posed regulations on the permitted sale of beer and wine would be con- <br /> sidered and reviewed with the assistance of the City Attorney; that <br /> methods of determim ng whether a group is charitable and therefore not <br /> charged a fee as compared with other groups which must pay a 6% fee <br /> will also be discussed with the City Attorney, the possible undesir- <br /> ability of permitting the sale of beer and wine at youth events, <br /> whether or not such sales might be perm�tted at fund raising events <br /> for youth activities but not at the activities themselves, the pro- <br /> visions for maintenance and cleanup after events, whether or not and <br /> to what extent the Parks and Recreation Department can and should <br /> police events, and the fact that it is the responsibility of the <br /> Park and Recreation Commission to issue regulations and they have <br /> invited policy direction from Council in that area <br /> Councilman Norris stated for the record that he opposes changes in <br /> present policy which would permit the sale of beer and wine in parks, <br /> believing government should not make it easier to obtain alcohol�c <br /> beverages , <br /> -5- <br /> � Reg.Mtg <br /> � 7/26/76 <br />
