On roll call, resolution was unanimously adopted. , RESOLUT ION No. 352 , AUTHORIZING CONDE�NATION OF AN EA3EI.;ENT ALONG3IDE PRESENT EA9EMENT ON PULGAS LINE FOR INTERCEPTOR $EYVER RESOLVED BY THE City Council of the City of Redwood City that it finde, determines and hereby declaree: � That publio interest and necesaity require the aoquisition, construction and oompletion by the City of Redwood City oY a publio improvement, namely: an interceptor sewer in aonnection with the aewage treatment and disposal ' plant of said City in that certain property hereinafter in thie Resolution deecribed; That�the uee of all of said lands for said interceptor sewer is a public use authorized bq law;_ ., .. That the adquisition of an easement�in said property is necessary to and Yor such public use and that it is neceasary that an easement in all of said property be eo acquired; 1'hat said interceptor sewer is planned and located in;.a manner which will be most compatible with the greateat public good and the least private • inJ �'Y' FURTHER RE30LVED that the City Manager ot thia City be and he is herebq authorizefl and empowered To aaquire an easeraent in the name of thie City in the real property hereinafter described for the conetruction and maintenanoe of eaid inter- ceptor sewer in accordance with the Code of Civil Procedure oY the State of California relating to eminent domain; To prepare and prosecute, in the name of thia City, such suit in the proper Court having Jurisdiction therein as ia necessary to condemn an easement in auch land for such use; , To make application to said Court for an order fixing the amount of euoh security in the waq of money deposits as said Court may direot to be made upon the takin� of possesaion of said property bq thie City, and for an order permitting this City to take imarediate posseseiop and use_pf„said property; To make deposit of sueh eecurity out of proper Yunda of said City in such amount so fixed and determined and in euch manner as said Court in which the condemnation proceeding hereby suthorized is pending may direat, The real property hereinabove referred to is eituated in the City of Redwood C�ity, County of 3an Mateo, State of California, particularly de- scribed as followe: � An easement in, over, under and along a etrip of land 10 feet in width, the southwesterly line of which is the northeasterly line of an easement now owned by said Gity of Redwood City, which line ie parallel with and distant 10 feet northeaeterlq from the northeaeterly line of the Pulgas Ranaho extending from the e0utheasterly line oY Roger 8treet to the easterly line of Middlefield Road; FURTHER RESOLVED that the City Manager be and he is hereby authorized to prosecute a suit in eminent domain to acquire said easement for the City of Redwood alty, ' � The above and foregoing Resolution was paesed and adopted by the Council oY the City of Redavood City at a regular meeting thereof held on the 17th day of June, 1946, by the following vote: AYES, and in favor oY the passage and adoption of the foregoing Resolution: Councilmen: ARMSTRONG, BRITSCHGI, GRANGER, Mc2dULTY, Bt7IFT, WERDER and HILTON.
