<br /> AN ORDER ADOPTING ENGINEER'8 REPORT CONFIRhfING THE AgSESS�4ENT AND
<br /> ORDERING THE i�'ORK.

<br /> RE30LVED, by the C1ty Council of the City oY Redwood City that:
<br /> SNHEREA3, on the 17th day of June, 1946, said Council adopted ite Reso-
<br /> lution of Intention No. 1946-1 to construct and inetall certain etreet im-
<br /> provements in said City, and referred the proposed lmprovement to EDG9IN H.
<br /> SN!ITH, a licenaed civil engineer of the State of California and being.a
<br /> , competent person appointed to prepare a report in accordance with 3ection 2
<br /> of the "Municipal Improvement Act 1913" including plana and specifications,
<br /> an estimate of costa, and other data required by said act; and
<br /> � WHEREAS, said report was duly made by eaid ED4YIN H. SMITH and approved
<br /> by DON S. PIILSON, City Engineer of said City after an examination thereof
<br /> and said report was filed with the City Clerk of said City, whereupon said
<br /> Clerk presented it to thi� City Council for consideration; and
<br /> WHEREAS, eaid City Council thereupon duly considered said report and
<br /> each and every part thereof,,and found that it contained all the mattere
<br /> and things called for by the provislons of Section 2 of eaid Act, including
<br /> (1) plans and epecificatione of the proposed improvement,,,(2) estimate of
<br /> costs, (3) diagram of district,, and (4) an assessment according to beneYits,
<br /> all of which was done in the form and manner required by said Act; and
<br /> �CHEREA3, said Council found that said report and each and every part
<br /> ' thereof was sufficient in every particular and determined that it ehould
<br /> etand as the report fbr all aubsequent proceed3ngs under said Act, where-
<br /> upon eaid Council, purauant to the requiremente of said Act, appointed
<br /> Thursday, the 18th day of July, 1946, at the hour of eight o�clock P,� „ of
<br /> said day, in the regular meeting place of said Council, in the City Hall in
<br /> said City, as the time and place for hearing protest in relation to�said
<br /> proposed improvemente, and directed the Clerk of said City to give riotice
<br /> of said hearing as required by said Act; and
<br /> WHEREA9, it appears that notices of said hearing were duly and regularly
<br /> posted in the time, form and manner required by said Act, as evidenced by
<br /> the affidavits on file with eaid Clerk, whereupon eaid hea,ring wae duly and
<br /> regularly neld at the time and places stated in said notices, and said hear-
<br /> ing was continued to this date; and
<br /> � ti4HEREA3, persone interested, objecting to certain portiona of said
<br /> improvement and to the eztent oP•the assessment district in regard thereto
<br /> have filed written protests �ith the Clerk of eaid City at or before the
<br /> time set for said hearing, and no other pereona interested objecting to
<br /> said improvement as a whole or to the boundaries of the aesessment district
<br /> in regard to the vuhole of said improvement, or to the proposed assessment or
<br /> diagram, have filed written protests with said City Clerk at or before the
<br /> time set for said hearing, and all persons interested desiring to be heard
<br /> were given an opportunity to be heard, and all matters and thinge pertain-
<br /> ing to said proposed improvements were fully heard and coneidered by eaid
<br /> Council, and said Council has acquired jurisdiction to order said improve-
<br /> ments and the confirmation of said diagram and asseasment to pay the costs
<br /> and expenses thereof.
<br /> NO'+�, THEFtEFORE, said Council does hereby FIND, DETERMINE and ORDER, as
<br /> follows:
<br /> 1. That the owners of one-half of the area to be asseased for the
<br /> ' coet of the project did not, at or prior to the time fixed for said hear-
<br /> ing, file written protesta against the said proposed improvements as a vuhole
<br /> or againet the dietrict or the extent thereof to be assessed for the costs
<br /> and expenses of said impiovements ae a whole, or as to the Engineer's esti-
<br /> mate of said costs and expenses, or againat the graces,at which said work
<br /> is provided to be done, or against the diagram.or assessment to pay for the
<br /> costa and expenses thereof.
<br /> 2. That the district benefited by said improvements and to be asseaeed
<br /> to'pay the costs and expenses thereoY, and the exterior boundaries thereoY,
<br /> is more particularly described in Resolution of Intention No. 1946-1, and
<br /> � made a, t her of by reference thereto. That all public streets and high-
<br /> ways wi���n sai� assessarent district, the same being in use in the perfor-
<br /> mance of a public function as such, shall be omitted from said diatrict and
