<br /> REPORT A$ AMENDED,_QONFIRMING THE ASSE98MEAT AND ORDERING THE YPORg
<br /> ' � (Resolution of Intention No. 1946-1)
<br /> RESOLVED by the City Council of the City of Redwood City that:
<br /> 6PHER�AB, the Council oY Redwood City on the 19th day of Auguat,
<br /> 1946, paes and adopt Resolutiori No. 380, entitled "Resolution of Intention
<br /> to 0rder Changes in tne Engineer�e Report, and Order Conflrming Aseessment
<br /> Under Resolution of Intention No._1946-1"; and
<br /> ' 4YHEREAB, said City Councll set aeide and reacinded the approval and
<br /> confirmation of the Engineer�s Report oY estimate of costs and aesessment
<br /> for the improvements mentioned in eaid resolution of intention as approved
<br /> and confirmed by said City Council by Resolution No. 365; and
<br /> �PHEREAS, said City Counail declared by said Resolution No. 380 ite
<br /> intention to increase the amounte of the assessment therein to the amount
<br /> ehown on an aesesement liet attached to said resolutlon, marked Schedule A,
<br /> and made a part thereoY; and .
<br /> • 4PHEREAB, in and by said Resolution No. 380, eaid Council Yixed Tuesday,
<br /> the 3rd day of 8eptember, 1946, at the nour of 8:00 o�clock p,m, of said
<br /> day, at the meeting place of eaid Counail in the City Hall on Middlefield,
<br /> of said City of Red'wood City, County of 3an Mateo, State of California, as
<br /> the day, hour and place, when and where any and a11 persone having any
<br /> objections to eaid re-aesesement for said improvements would be heard, and
<br /> caused a copy, of eaid Resolution No. 380 to be publiahed once in the Red-
<br /> wood City Tribune at leaet ten days before said day for hearing objectione
<br /> to said re-assessment; and
<br /> R�HEREAS, at•the time and place mentioned, no objections were made
<br /> againet said re=asseasment; and
<br /> WHEREAS, eaid Council of eaid City of Redwood City has now acquired
<br /> , jurisdiction to finally approve and conYirm the engineer'e report ae amendeu
<br /> and
<br /> WHEREAB, eaid City Council thereupon dulq conaidered said report ae
<br /> amended and each and every part thereof, and found that it contained all the
<br /> matters and thinge called for by the provisions oP 9ection 2 of the "Muni-
<br /> cipal Improvement Act of 1913", including (1) plans and epecificatione of
<br /> the proposed improvement, (2) estimate of ooets, (3) diagram of distriat,
<br /> and (4) a nev� asaeesment according to benefite, all of whicri was done in'.the
<br /> form and manner required by said Act; and
<br /> WHEREA3, eaid Council found that eaid report and each and every part
<br /> tnereof was sufficient in every particular and determined that it should
<br /> etand as trie report for all eubsequent proceedinge under eaid Act;
<br /> • NOW, THEREFORE, eaid Qouncil doe8 hereby FIND� DETERMINE and ORDER�
<br /> as follows:
<br /> 1. That the ownere or one-nalf of the area to be assessed for the
<br /> coat of the project did not, at or prior to the time fixed for said hearing,
<br /> Pile written protests againet the said proposed improvemente se s whole,
<br /> or against the district or the extent thereof to be aesessed for the coete
<br /> and expenses oY said improvements as a whole, or ae to the Engineer's
<br /> eatimate of said ooste and e�enses, or against the gradea at which said
<br /> work is provided to be done, or againat the diagram or assesament to pay
<br /> ' for the costs and expenses thereof.
<br /> 2. Triat the district benefited by eaid improvements and to be aeseseed
<br /> to pay the coets and expensea thereof, and the exterior boundaries thereoi,
<br /> is more particularly deaoribed in Resolution of Intention No, 1946-1, and
<br /> made a part riereof by reference thereto, That all public etreets and
<br /> hignways veithin said assessment dietrict, the same being in uee in the per-
<br /> formance of a public function as such, ehall be omitted from said dietrict
<br /> and from the levy and colleotion of the epecial taxes to be hereafter levieu
<br /> ' and collected to cover tne costs and expenaes of said improvemente.
<br /> 3. That the plane and epeoifications for the propoeed iroprovemente,
<br /> contained in said report, be and they are riereby finally adopted and ap-
<br /> proved as tne plane and epecifications to which said work ehall be done as
<br /> called for in said resolution of intention.
<br /> 4. Tnat the Engineer�s estimate of tne itemized and total eatimated
<br /> costs and expenses of said lmprovements, and of the incidental expenees in
<br /> connection therewith, contalned in eaid report, be and it is hereby finally
<br /> adopted and approved as the Engineer�e total and detailed eetimate oP the
<br /> • costs and expenses oP said improvements,
