make the findings, and adopt the statements of overriding considerations, all as <br /> set forth in detail in the Attachment "1" attached hereto and incorporated in this <br />_ Resolution by this reference and the exhibits attached thereto (Exhibits "A" <br /> through "E" ). The statements, findings and determinations set forth in <br /> Attachment "1" are based on the certified Final EIR and other information <br /> available to the City Council and the Agency, and are made in compliance with <br /> Sections 15091, 15092, and 15093 of the State CEQA Guidelines and Section <br /> 21081.6 of CEQA. <br /> 3. The Agency and City find that approval of the Cinema DDA and the <br /> Project it authorizes, under the circumstances of this particular case and the <br /> conditions specified herein, will not be detrimental to the health, safety, peace, <br /> comfort and general welfare of persons residing or working in the neighborhood <br /> or to the general welfare of the area. The Agency and City find that the Project, <br /> as compared to the existing condition, will be more beneficial to the health, <br /> safety, peace, comfort and general welfare of persons residing or working in the <br /> neighborhood and to the general welfare of the area because the Project will help <br /> revitalize the downtown area, attract patrons to the movies over and over again <br /> throughout the year, who are considered likely to shop at downtown stores and <br /> dine at downtown restaurants. The Project is expected to stimulate the activity <br /> that would support downtown jobs and increase sales tax revenues from nearby <br /> outlets but also revitalize and enliven an entire commercial district. <br /> 4. That certain agreement entitled, "Disposition and Development <br /> Agreement for Downtown Retail-Cinema-Office and Parking Project," by and <br /> between Western Innisfree Ventures, LLC, the City and this Agency, which has <br /> been executed by Western Innisfree Ventures and delivered to the Executive <br /> Director of the Agency, hereby is approved by the Agency and the City, and the <br /> <br /> 6 RD-040 <br /> Concurrent Cinema Resolution: <br /> _ 1/24/01 <br /> <br /> <br />
