6.1. F. - Page 4 <br /> 2. Place of Performance. The Performers shall perform outdoors in a City-owned <br /> parking lot located at the corner of Jefferson Avenue and Middlefield Road and <br /> adjacent to the Redwood City Public Library in downtown Redwood City (the "Place <br /> of Performance"). <br /> 3. Schedule of Performances. The Performances shall take place pursuant to the <br /> schedule set forth in Exhibit "A" attached hereto and incorporated herein by this <br /> reference (the "Schedule of Performance"). <br /> 4. Compensation. The City agrees to pay a Performance Fee of $76,000 <br /> ("Performance Fee") for the rendition of Performers' services described above. <br /> Additionally, City will pay Zoppe, within 30 days of the final performance, a bonus of <br /> $5,000 if retail ticket sales exceed $130,000 and an additional bonus of $2,500 if <br /> retail ticket sales exceed $140,000. <br /> The Performance Fee shall be payable as follows: <br /> (a) Upon execution of this Agreement and compliance with Section 16 <br /> (Insurance), City shall pay Performers' Agent $26,000. The City shall mail a <br /> check in this amount to Performers' Agent at the address listed in Section 8 <br /> (Notice). <br /> (b) Upon arrival of Performers to the Place of Performance for setup as set <br /> forth in the Schedule of Performance, City shall pay Giovanni Zoppe $25,000. <br /> Payment of this amount will be hand delivered to Giovanni Zoppe at the Place of <br /> Performance by the City. <br /> (c) Two (2) days prior to the final day of performance, the City shall pay the <br /> remaining balance of $25,000. Payment will be hand delivered to Giovanni <br /> Zoppe at the Place of Performance by the City. <br /> (d) Within 30 days of the final performance, the City shall additionally <br /> compensate Zoppe as set forth below: <br /> i. If total gross retail ticket sale revenues are between $130,000 <br /> and $140,000, Zoppe will be paid a bonus of $5,000; or <br /> ii. If total gross retail ticket sale revenues exceed $140,000, Zoppe <br /> will be paid a bonus of $7,500. <br /> 5. Arrival and Set-Up Time. Performers must arrive no later than one hour prior to <br /> performance time on each date specified in Exhibit "A." At least one hour prior to the <br /> time of the first performance of the day, the City shall provide Performers and their <br /> designated representatives sufficient access to the Place of Performance for set-up <br /> and sound check. <br /> ATTY/AGR/2011.045 2 <br /> 072011 <br />
