General No.1 (continued)

assumed that the wall would be constructed of five feet wide and seven feet
high panels; that to satisfy concerns regarding noise reduction a costly
acoustical study was done; that staff has gone farther to ameliorate the
situation than for any other neighborhood; that the Atherwood development has
en joyed a peacefu 1 area for twenty years, but oust recognize the
inevitability of development of vacant parcels; and described the
alternatives with regard to fence height, materials, and fabrication.

I '

Mario Biagi, 900 Veterans Boulevard, representing the developer, D.K.
Development, stated that ouch of the discussion regarding changes to the
fence that went on over the past several months h ad been without the
developer having been made aware of them; that originally it was to have been
a redv.ood fence; described the subsequent disagreements as to where the posts
would be, what materials would be used, whether it ought to be installed with
cut-outs to accommodate the trees; that alternatives are: a six-foot high
fence with concrete posts; seven-foot high with 15 foot panels, which v.ould
have to be lifted by crane and dropped into place, arx:1 it \\Ould be difficult
if not imposs ib le to save the trees; seven-foot redv.ood fence; or bui ld a
straight wall, remove all the trees and replace them. He added that the
developer is anxious to get on with the project because of the time involved
between ordering materials and their delivery.

Larry Irons, 105 atherwood, indicated he had not previously been aware of the
options until now.

City Manager Smith and City Attorney Schricker questioned the reason that the
matter is before Council, noting that it is not an appeal, arx:1 that it is
really a matter before staff for determination as to whether condit ions
imposed are being adhered to.

Pat Sikora,
the June 17
the various
and that it
concerns.

165 Atherwood Avenue, restated in detail her comments made at
Council meeting, regarding their concerns, their contacts with
interested departments, the desire for a 7-foot acoust ical fence
be constructed so as not to disturb the existing trees, and other

MIS: Claire/Mosher to accept the staff report and advise the developer to
follow through with the staff recommendations.

On the advice of City Attorney Schricker, Councilman Claire added to his
motion the declaration that the motion is not enforceable, since Council does
not have jurisd i ct i on.

MOTION WITHDRAWN

Following additional discussion, Councilman Claire, with consent of his
second, withdrew his motion.

Discussion continued regarding the fact that if the conditions in the Planned
Development are taken literally, that v.ould mean installing a straight wall
along the property line, and Mr. Biagi (see above) believed this would be the
most satisfactory to the developer because it \\Ould make a clean line and
would allow planting of new trees and other larx:1scaping that would make the
property more attractive.

Reg.Mtg.
6/24/85
P ag e 5

MINUTE BOOK NO. 45
Page No. 492
