DES:dft f '/31/94 (008/38) <br /> DES :djk ~/04/94R <br /> <br /> 1. This Council hereby finds and declares that the public <br />interest and convenience require the establishment of the <br />hereinafter described underground utility district. <br /> <br /> 2. The district proposed to be established shall be <br />designated as "Underground Utility District No. 1994-1" <br />(hereinafter, the "Proposed District"). <br /> <br /> 3. The boundaries of the Proposed District are more <br />particularly described and depicted in Exhibits "A" and "B", <br />respectively, attached hereto and by this reference incorporated <br />herein. <br /> <br /> 4. The purposes of the Proposed District are hereby <br />declared to be as follows: to require the placement underground <br />of all existing overhead utilities, including service drops, <br />removal of all wood utility poles, overhead wires and associated <br />structures from any streets, roads, alleys or ways within the <br />Proposed District and to require that all future wires and <br />facilities for supplying electric, communication, and/or similar <br />services shall be installed underground. <br /> <br /> 5. The following facilities, to the extent such facilities <br />shall be included within the Proposed District, may be maintained <br />above-ground: transformers, pedestal-mounted service terminals, <br />wires (exclusive of supporting structures) crossing any portion <br />of the proposed District when such wires originate and terminate <br />in an area from which poles and overhead wires and associated <br />overhead structures are not prohibited, and such other facilities <br />as the Council shall determine upon completion of the hearing <br />hereinafter described. <br /> <br /> <br />
