Section 2.2.3-I-1 is hereby amended to add the following subsection <br /> (c) after subsection (b): <br /> c. Otfice uses are prohibited in the front portion of the ground floor <br /> (/ess than 20 feet from the front of the building) in the <br /> Entertainment District use zone and Downtown Core use zone <br /> along frontages with the heavy black line as indicated on the Use <br /> Regulations Map. During periods of high ground-floor vacancy <br /> rates, uses in the Office use group may be permitted in such <br /> areas subject to the following conditions: <br /> • Ground floor otfice uses in the areas described above must <br /> obtain a Use Permit, which shall be acted upon by the <br /> Zoning Administrator in accordance with the procedure set <br /> forth in Section 2.2.5. <br /> • In addition to the submittals required pursuant to Section <br /> 2.2.5, the application for a Use Permit for ground floor <br /> office uses in the areas described above must provide <br /> evidence satisfactory to the Zoning Administrator <br /> identifying at /east 40,000 square feet of presently vacant <br /> ground floor space within the Entertainment District use <br /> zone and Downtown Core use zone. The application must <br /> a/so provide evidence that the proposed use will not cause <br /> more than 40% of the linear frontage of any block face of <br /> Broadway to be occupied by otfice uses. <br /> • Such uses must be temporary in nature. Any Use Permit <br /> granted for ground floor otfice uses in the areas described <br /> above shall be for a fixed period of time as deemed <br /> appropriate by the Zoning Administrator but not to exceed <br /> five years, and shall automatically terminate on the <br /> expiration of that period. Notwithstanding the foregoing, <br /> one year extensions of the Use Permit may be granted if, no <br /> more than seven months and no /ess than five months prior <br /> to the expiration of the Use Permit, the applicant can <br /> provide evidence satisfactory to the Zoning Administrator <br /> demonstrating that at /east 40,000 square feet of ground <br /> floor space remains vacant within the Entertainment <br /> District use zone and Downtown Core use zone.
