The City and Property Owner agree that t�e heait�, safety and welfare of the <br /> citizens of the City req�aire that the stormwater treatment measure(s} detailsd irt #he Sit� <br /> Plan or comparable document be constructed and maintained on the Property; and <br /> I. The City`s Stormwater Management 4rdinance, guidelines, criteria ar�d other <br /> written directions require that the stormwater trea�ment measure(s}, as shown on the <br /> approved Site Plan ar camparable dacument, be cor�structed and mair�tained by the <br /> Properly 4wner. <br /> AGREE{VIENT <br /> NOW, THEREFORE, in consideratian of the b�nefit recei�ed by the Properly Owner <br /> as a result of the Ciiy`s appro�al of#he S9te Plan, the Property Qwr�er herehy co�enants <br /> and agrees with the Ci#y as follows: <br /> 1. Cor�struction of Trea#ment Measures. The on-site stormwa�er trea�ment <br /> measure(s) shown on the Site Plan document shall �e constructed by the Property Owner <br /> in conformance wifh the approved plans and specifications identified for the development <br /> ar�d ar�y ofher requirements thereta whic� ha�e been approved by the City in conformar�ce <br /> with appropriafe City ordinances, guidelines, criteria and other written directian. <br /> 2. Opera�ion & M__aintenance Responsibility. This Agreement sha�l serr�e as #he <br /> signed statemenf by the Property Owner accep�ing responsibility for operation and <br /> mair�tenance of sformwater treatment measures as set forth in this Agreement until #he <br /> responsibility is legally transferred to another person or entity. Before the Property is <br /> legally transferred to ano�her person or enfity, the Property Owner shall provide to the <br /> � City at leas� or�e of the fol[owing: <br /> a. Written condi�ions in the sales agreemen# requiring the �uyer to assume <br /> responsibility for operation and maintenanee (O&M) eonsisten� with fhis provision, which <br /> cor�ditions, in the case of purchase and sale agreements, shall be writter� to surviue <br /> beyond the close of escrow, or <br /> b. Written text i� �roject car�ditions, covenants artd rest�ictions (CC&Rs) for <br /> residential properties assigning O&M responsibilifies to tl�e home owners association for <br /> O&M of�he treatment measures, or <br /> c. Any other legally enforceable agreemer�t or mechanism that assigns <br /> responsi�ility for the maintenance of treatment measures. <br /> 3. Mair�tenar�ce of Treatment Measures. Ti�e Property Owner shall not destroy or <br /> remo�e #he stormwater treatmer�t measures from the Property nor modify �he stormwater <br /> freatment system in a manner �hat Iesser�s its effecfiveness, and shall, at Property <br /> 4wner`s sole expense, adequately maintain the stormwater treatment meas�re{s) in <br /> good v�or�Cing order acceptable to the City artd in accordance with the Site Plan.
