-9- <br /> 8.A. - Page 98 rescinding the approvals related to the Finger Avenue Project, the Cify <br /> agreed to prepare an environmental impact report {EIR) #o ar�a�yze the related <br /> er�vironmental impacts associated with the Finger Avenue Project. The Settlement <br /> Agreement stipulated the foflowing topical areas for evafuation in the EfR: <br /> Topical areas for evaluation consistent wifh the Settlement Ag►�eemenf: <br /> • Aesthetics <br /> • Cultural Resot�rces <br /> • Cordi�leras Creek impacfs relating to stormwater runoff, geolo�y, water quality, <br /> biofogy, erasion and bank stability (including impacts to the poter�#ia! restoratian <br /> of tF�e creek related to the City's alFowance of de�elopment within 25 feet of fihe <br /> creek bank pursuanf to section 32.'12 af the City's Mur�icipal Code) <br /> • Traffic satefy <br /> • Parking, and <br /> • �and uselneighborhood compa#ibility <br /> The Pa�ies f�rti�er agreed that the 2008 �nitia! Study associated with the Mitigated <br /> Negative Decfaration (MND) suffici�ntly e�aluated the Project's remaining poterrtial <br /> impacts and so the EIR need not eva�uate potential irnpacts other than those listed <br /> above. <br /> The Settlemer�t Agreement also stipulated the minimum range of project alternatives to <br /> be considered in the eRVironmerttal rerriew for the Project, designed to be potentially <br /> feasible and to meet most project objectives. The parties a�reed that the alternatives <br /> provided below constitute a reasonable range of alternatives to the Project pursuant to <br /> CEQA Guideline Section 15126.fi. The parties aiso agreed that fhe City as lead agency <br /> retained its discretron to de#ermine whether additional EIR a!#ernatives would be <br /> evalr�ated. <br /> Project Alternatives for evaluation consistenf wifh Settlement Agreement: <br /> 4. The no project alterr�ative required under CEQA; <br /> 2. Devefopment on the Project site oonsistir�g of tour or five single-family dweUings <br /> plus accessory dwellings as allowed under the existing R-1 (Residential Single- <br /> Famify} District zoning standards without a Planned Development Permit or Use <br /> Permit; and <br /> 3. De�elopment on the Projec# site with a Planned Development Permit under <br /> Article 46 of the Redwood City Zoning Code that ir�cludes res�dences set bac�c a <br /> minfmum of 2� feet from fhe top of the bank of Cordifleras Creek (as "top of <br /> bank" is defined in Article 2 of the City's Zoning Code}, a private roadway <br /> designed to Cify standards with a si�gle entrance or�to Finger Avenue, and rear <br /> and side setbacks compliant with R-1 District standards where the Project parce! <br /> directly ad�oin parcels in the existing neighborhood. <br /> From January 25, 201'� through February 23, 2011 the City held a public review period <br /> on the Notice of Preparation (IVOP) for the Project EIR. The City mailed, published and <br /> posted the NOP on its website to notify responsible agencies of the State Office of <br /> Plan�ing and Research, a�l parties to the Settlement Agreement and surrounding <br /> property owners that an EIR would be prepared for the Finger Project in accordance <br /> with the stipuiated judgment of the Superior Court for the County of San Mateo. <br /> � <br />
