-21- 8.A. - Page 110 Mitigation: In compliance with the Migratory Bixd Treaty Act and the Califamia Fish and Game Code, the fallowing measures shall be imp�emented during the construction of the praject to reduce and avoid construction-rela�ea impacts to nesting raptors, migratory birds, and/or bats: MM BIO - 2.1: Preconstruction nesting bird surveys shall be conducted by a qualified wildlife biologist within two weeks of demaIition/construction acfivities scheduled ta take place between February 1 and J'uiy 3 7 {breeding season). All trees within the groject area shall be surveyed. If active raptor or passerine nests are detected during #he pre-construction surveys, a na-disturbance buffer zane shall be designated and maintained around the nest until a qua�ifed biologist has detennined that the young have fledged from the nest. The size of the no- disturbance zone shall be determined in consulta�ian with the CDFG. MM BIO - z.2: A minimum of one preconstruction bat survey shall be conducted by a qualified �at bioiogist (a biologist holding a CDFG collectian permit and a Memarandwn of Understanding with CDFG aIlowing the biologist to handle and col2ect bats) shall be canducted prior to tree remaval or demolition activities. If no bats are detected, then no further surveys are required. However, if bats are detected in a tree ar stiucture on the site, the bats shal� be passi�ely exc�uded/evicted from the roost area for two consecutive days. Tree removal and/or demolition shall occur not less than the day foliowing the two consecutive days of exclusion/eviction. Prior to removing any trees defined as an ordinance size under the City of Redwood City's Tree Preservation Ordinance, the applicant sha11 appiy for a tree removal permit. Under the Ordinance, the value of the tree to �e removed, as determined by a certified arborist, must be replaced with #he pZanting of new trees.
