Applicant shali enter into a Stormwater Treatment Measures Ma�ntenance Agreement, in accardance with Provision C.3.e of the NPDES permit, which agreement shafl pro�ide, among other thing, that: (i} The applicant accep#s responsi�ility for the adequate installatioN construction, operation, ma�ntenance, inspection, and reporting of any on-site stormwater treatment measures being incorporated into the project unti! the responsibility is legally tra nsferred to another entify; and (ii} The applicant provides and ensures (ega� access to the on-site stormwater treafinent measures for representatives of the City, the local vector control district, and staff of #he Reg ional Water Quafity Cor�trol Board, San Francisco Region, fof the purpose o� verifying the implementatFan, operation, and maintena nce of the on-site stormwater trea#ment measures and taking correc#ive action if �ecessary. The agreemer�t sha(I be reviewed a nd appro�ed by the City prior to recordation and recorded at the County Recarder's Office at the applica�t's expense, 36.T�e applicant shalf submit an Erosion and Sediment Control Plan to the City Engineer for review and appro�al prior to commencing any work on the project, ir�cluding demolition or grading work. The Plan shall show Best Management Practices (BMPs} for storm water pollution preventior�. Additionally, the plan shall include specific provisions for the protection of the creek from erosion, sedfinent, and constructior� debris. All construction work in conr�ection w�th this project must conform to the appro�ed Erosion and Sediment Contro! Plan. 37,Prior to commencing any work on #he project, inctuaing dernolition ar grading work, the applicant shall post at all entries to the project site in clear view of the public right-of-way, a sign as required by RCMC Section 24.33 indicating the hours of construction and limitations on construction noise. Addi#ionally, the sign shall include a phone number of t#�e applicar�t's designated con#act for complaints about problems with fhe construction activ�ty. 38.The applECant sha�l be responsible for the cost of repairs #o any improvements within the public right-of-way that are damaged during construction. The appiicant shafl submit docUmentation of the existing condition of Finger A�enue from the westerly extent of the project site to the intersection of Finger Avenue and EI Camino Real and the public improvements along the project's frontage, including but not limited to trees, tree grates, signs, fight poles, drainage inlets, curbs, gutters, etc. to the satisfaction of the City Engineer prior #o issuance of a grading or buElding permit.
