8.A. - Page 80 <br /> ATTACHMENT3 <br /> 25.There are three existing driveways into the Project site. Those portions of <br /> these driveways outside of the intersection of the private roadway with Finger <br /> Avenue shall be reconstructed to match the existing street improvements <br /> along Finger Avenue, including the sidewalk, planting area, and curb and <br /> gutter. The installation of new street trees and maintenance for at least two <br /> years until they are established is required to ensure that the spacing of street <br /> trees along Finger Avenue is continued across the Project's frontage on <br /> Finger Avenue. Street trees species, spacing and size shall be coordinated <br /> with Public Work Services, Street Tree Division. <br /> 26.Applicant shall submit to the City for review and approval Covenants, <br /> Conditions and Restrictions that demonstrate how applicant intends to use a <br /> Home Owner's Association to implement and comply with common area <br /> Conditions of Approval and CEQA Mitigation Measures. The Covenants, <br /> Conditions and Restrictions (CC&Rs) shall provide for the maintenance of all <br /> infrastructure and utilities within the Project site or constructed with <br /> encroachment permits within the Finger Avenue right-of-way to serve the <br /> Project which serve two or more lots and are not accepted by the City or a <br /> utility company for maintenance. This shall include, but not be limited to, the <br /> private roadway, the five shared parking spaces, sidewalk, common <br /> landscaping, and the stormwater drainage and sewer collection systems. The <br /> CC&Rs shall be submitted to the City Engineer or designee for review and <br /> approval prior to Final Map approval. The CC&Rs shall be recorded with the <br /> Final Map. <br /> 27.All infrastructure and utilities serving two or more lots shall be located within <br /> easements to provide for ongoing maintenance and possible replacement. The <br /> easements shall be to individual property owners or the Homeowners <br /> Association, or, where the utilities and infrastructure is to be accepted by the <br /> City or a utility company, a Public Utilities Easement shall be provided. These <br /> easements shall include a public utilities easement to the satisfaction of the <br /> City Engineer, if the City accepts the water and sewer mains within the private <br /> street for maintenance purposes. These easements shall be shown on the <br /> Final Map. <br /> 28.Applicant shall submit improvement plans which include complete sets of <br /> plans, profiles, cross sections and specifications for the proposed <br /> improvements which shall be in conformity with the current design standards <br /> in force and the standard specifications of the City unless exceptions have <br /> been granted, on reproducible material, in a form acceptable to the City <br /> Engineer or designee for his review and approval. <br /> The minimum subdivision improvements that shall be required include the <br /> following: <br /> ATTY/RES0.2785/FINGER RESO APPROVING VTM FINAL <br /> REV:08-31012 VR <br /> Page 12 of 20 <br />
