8.A. - Page 157 ATTACHMENT3 RESOLUT�ON NO. _ _ A RE50LUTI�N QF THE CITY COLJNCIL OF TH� CITY OF REDWOOD CITY APPR�VING A VESTING TENTATIVE MAP PURSUANT TO THE SUBDIVISION MAP ACT AND THE REDWQOD CITY MUNICIPAL CODE WHEREAS, Kirk McGowan dba McGowan Developmen# ("Applicant") submitted applications ta the City of Redwood City ("City") for (i) a Planned De�elopment Permit, including Modifications to zoning district regulations, and (ii) a Ves#ing Tentative Map including Exceptions to the Subdivision Ordinance (the "Finger A�enue Project" or "Praject"); at�d WHEREAS, the Pfanning Cammission of the City of Redwood City ("Cammission"} is empowered by Article 46 (Planned Development Permits) ta act upon applications for planned developm��t permits; the Commission is als4 empowered by the 5ubdivisian Map Act and th� Redwood City Municipal Code to consider V�sting T�ntative Map Applications; and WHEREAS, pursuant to a Settlement Agreement dated July 26, 20�Q by and among Applicant, City, and the Friends of Cordilleras Creek and F'iinger A�enue Pride Committee ("Friends"), among other things, the City agreed to prepare and certify an Environmental Impact Repor# for the Praject pursuant to California Environmental Quality Act ("CEQA") before it may approve the Project. The City also agreed that the Project and Environmental Impact Repart would be considered by both the City's Planning Commission and City Cauncil; and WHEREAS, vn June 19, 20�2, the Planning Commission held a duly noticed public hearing on the Finger Avenue Praject, inciuding the Final Environmental Impact Report for the Finger Avenue Nine-Lot Planned Develapment Project ("FinaF EIR"), and recommended that the City Council (1) certify the EIR, adopt the necessary CEQA Findings, and adopt a Mitigatian Monitoring and Reporting Plan in accordance with CEQA, by Resolution No. �2- 16; and (2) strangly consider appraval of the alternative identified in the Final EIR as the "Project with 25 Faot Creek Setback Aiternative" without (a} increasing home sizes elsewhere in Lats 1�4, (b) reducing front yard setbacks or driveway aprons, ar (c) removing heri#age trees other than those (1 Q trees) already proposed for remova! by the Project applicant, by Resalution Na. 12-19; and WHEREAS, the "Praject with 25 Foot Creek Setback Alternative" is similar to the Project as propased by the de�eloper exce�t that the residences on Lats �-4 would be set�ack 25 feet from the top of creek bar�k and reduced ir� size by ATTY/RES0.22641APPROVING A VESTING T£NTA7IVE MAP{FINGER AVE} REV:07-02-12 VR Page] of 1$
