CONTRACTOR'S STATUS. ln the performance of the abligations set fnrth in this <br /> agreement, Cor�tractor shall ha�e the status of an independent contractor and shall nat be deemed to be <br /> an employee, agent or officer of City. <br /> 11. NOLD hiARMLESS. Contractor hereby agrees to defend, inder�nify and sa�e harmless <br /> City, its Cauncil, officers, boards, commissions, agents and employees (collectively, "Indemnitees") <br /> against and from any and all claims, suits or actions of e�ery name, kind and description, damages, <br /> losses and expenses including atkomey fees, arising from, or alleg�d to ha�e arisen from, any act or <br /> omission to act, negligent or otherwise, of Contractor, its oificers, agents or emplayees under this <br /> agreement. <br /> 12. NON-DISCRIMINATION AND EQUAL OPPORTUNITY. Contractar hereby warrants and <br /> agrees that, in the performance of this agreement, it will not, in connection with the employment, <br /> advancement ar discharge of employees, or in connection with the term5, conditions ar privileges of their <br /> empinyment, discriminate against person because of tneir age, except upon tF�e basis of bona fide <br /> occupational qualifcation, retirement plan or statutory requirement, and will not specify, in solicitations or <br /> ad�ertisement for employees to work on this contract, a maximum age lirr►it, unless such limit is based <br /> upon a bona fide occupational quali€ication, retirement plan or statutory requirement. <br /> Contractor further warrar�ts and agrees that it wiil comply with afl provisians of executi�e Order <br /> 19246 of 5e�tember 24, 1965, and af the rules, regulations an� rele�ant orders of tF�e Secretary af Labor; <br /> and that it will not discriminate against any empioyee or applicant for empfoyment because of race, color, <br /> religion, sex or national origin.
