<br /> City shall monitor Contractor's Program and expenditures made pursuant to this agreement semi-
<br /> annually to verify Contractor's compliance with this agreement and �ocal contract requirements.
<br /> 10. CONTRACTOR'S 5TA7U5. In the performance af the obligafions set forth in this
<br /> agreernent, Contractor shafl have the status of an independent contractor and shall not be deemed to be
<br /> a� employee, agant ar officer of City.
<br /> 11. HOLD HARMLESS. Cantractor hereby agrees to defend, indemnify and save harmfess
<br /> City, its Council, officers, boards, commissions, agents and emplayees (collecti��ly, "Indemnitees")
<br /> against and from any and all claims, suits or actions nf every nam�, kind and description, damages,
<br /> losses and expenses including attorney fees, arising fram, or alleged ta ha�e arisen from, any act or
<br /> omission to act, negligent or otherwise, af Contractor, its officers, agents or employees under this
<br /> agreement.
<br /> 12. NON-DESCRIMINATION AiVD EQ�AL OPPORTUfVITY, Cantractor hereby warrants and
<br /> agrees that, in the pertormance of this agreement, it wii! not, in connection with the employment,
<br /> advancement or discharge of employees, or in connection with the terms, conditions or privileges of their
<br /> employment, discrimir�ate against person because of their age, except upon the basis of bona fide
<br /> occupational qualificatian, retirement plan or statutary requirement, and will not specify, in solicitations or
<br /> advertisement for employees to wark on this contract, a maximum age limit, unless such limit is based
<br /> upan a bona fide occupational qualification, retirement plan or statutory requirement.
<br /> Contractor fur#her warrants and agrees that it will comply witF� all pro�isions of execu#i�e Order
<br /> 1�246 of SeptemEaer 24, 1965, and of the rules, regulations and relevant orders of the Secretary of Labor;
<br /> and that it will not discriminate against any employee or applicant#or empfoyment because of race, color,
<br /> religion, sex ar national origin. Contractor will take affirmative actian #o ensure that applicants are
<br /> employed and that employees are treated during employment, without regard to their race, color, religion,
<br /> sax ar national origin. Such action shall include, but not b� limited to, the fallawing: employment,
<br /> upgrading, demotion, or transfer, recruitm�nt or recruitment advertising; layoff or termination; rates of pay
<br /> or other fnrrr�s of compensation; and selsction for training, including apprenticeship.
