6.4.A. - Page 4 <br /> ATTACHMENT1 <br /> DEPARTMENT: The Department, Division or City employee to whom responsibility for <br /> the administration of this Article has been delegated by the City Manager. Generally the <br /> police department will process applications for block parties and the Community <br /> Development Department will process applications for temporary use permits. <br /> Applications for special events may be assigned by the City Manager based on the type <br /> of event. Persons seeking permits pursuant to this Article may obtain necessary forms <br /> and information from the permit counter at City Hall. <br /> SPECIAL EVENT: Any concert, parade, circus, fair, festival, community event or other <br /> temporary outdoor activity proposed to be conducted on public or commercial property <br /> with fifty (50) persons or more in attendance. <br /> PARADE: Any march procession or assembly consisting of persons, animals or <br /> vehicles, or a combination thereof, upon any public right-of-way, which does not comply <br /> with normal and usual traffic regulation or controls. <br /> TEMPORARY USE: Any use of public or private property for uses not normally <br /> authorized as permanent, permitted uses by the zoning ordinance, including but not <br /> limited to uses such as: film/video productions, off-site sales events, swap meets, flea <br /> markets, pumpkin patches, Christmas tree lots, sports tournaments, outdoor art and <br /> craft shows and exhibits <br /> Sec. 33A.3. CITY FUNCTIONS <br /> Street closures by the City for municipal purposes, including, but not limited to, <br /> conveyance of traffic, travel, City events sponsored solely by the City are exempt from <br /> the requirements of this Article. <br /> Sec. 33A.4. ADMINISTRATION AND ENFORCEMENT <br /> It shall be the duty of the Department to administer and enforce the provisions of this <br /> Article. <br /> Sec. 33A.5. FEES <br /> Applicants shall pay an application fee and all other fees as determined by City Council <br /> resolution. <br /> Sec. 33A.6. PERMIT REQUIRED <br /> It shall be unlawful for any person to participate in, advertise for or in any way promote, <br /> organize, control, manage, solicit or induce participation in a block party, special event <br /> or other temporary uses regulated by this Article unless a permit has first been obtained <br /> for such activity. No person shall violate any of the terms of a permit issued pursuant to <br /> this Article, nor join or participate in any permitted activity under this Article over the <br /> objection of the permittee, nor in any manner interfere with the progress or orderly <br /> conduct of the perm itted event. <br /> ATTY/ORD.380/TEMPORARY USE PERMIT <br /> REV: 10-17-12 JS Page 2 of 8 <br />
