For parades: Ten (10) days prior to the date proposed to conduct the parade. <br /> However, where good cause is shown, the Department shall have the authority to <br /> consider an application which has been filed less than ten days before the parade <br /> date. <br /> D. For temporary use Permits: Sixty (60) days prior to the date proposed to begin the <br /> temporary use. <br /> Failure to file within such period is sufficient grounds for denial of a permit. <br /> Sec. 33A.9. NOTICE OF APPLICATION <br /> At least ten days prior to approving a permit for a special event or temporary use <br /> pursuant to this Article, the Department shall ensure that written notice of the proposed <br /> event or use is (i) posted in at least three conspicuous places at the location proposed <br /> for the event or use; and (ii) given through the United States mail, with postage prepaid <br /> or by hand delivery to all persons (including businesses, corporations, or other public or <br /> private entities) owning or residing at the real property located adjacent to the location <br /> of the event or use. The notice shall specify the type and magnitude of the application <br /> to be considered, the place where copies of the application may be reviewed, the timing <br /> of approval, and a statement indicating the ability of any interested party to (i) submit <br /> comments to the Department, (ii) request notice of the action on the application, and (iii) <br /> appeal. The notice described above shall be provided at least five (5) days prior to <br /> approving a permit for a Block Party. The Department shall provide a form to be used to <br /> provide such notice. This section does not apply to parades. <br /> Sec. 33A.10. CONDITIONS OF APPROVAL <br /> Permits issued pursuant to this Article shall be subject to the following conditions: <br /> A. For block parties: <br /> 1. Must be conducted within an area not exceeding one City block or one <br /> intersection, in the City, with at least two-thirds (2/3) of the area residentially <br /> zoned; <br /> 2. A majority of the residents fronting on the location where the block party will be <br /> held must consent to the event; <br /> 3. Must be sponsored solely by owners, residents or tenants of property fronting the <br /> location of the event; <br /> 4. May not be for commercial or advertising purpose and no commercial activity <br /> may occur at the event; <br /> 5. Applicants shall provide and remove such barricades and warning devices as are <br /> deemed necessary by and are acceptable to the Department; and <br /> 6.
