· <br /> <br />Section 1.5. "Bins" means Solid Waste Containers, <br />rectangular in shape, irrespective of size. <br /> <br /> Section 1.6. "Collect" or "Collection" means the <br />collection, transportation and removal of Solid Waste within and <br />from Agency's Service Area. <br /> <br /> Section 1.7. "Commercial and Industrial Property" means <br />property used for conducting businesses thereon including, but <br />not necessarily limited to, rentals of four or more dwelling <br />units in a single or connected structure, retail sales, services, <br />wholesale operations, manufacturing and industrial operations, <br />but excluding businesses conducted upon Residential Property (as <br />hereinafter defined). <br /> <br /> Section 1.8. "Company" means Browning-Ferris Industries of <br />California, Inc., a corporation organized and operating under the <br />laws of the State of California. <br /> <br /> Section 1.9. "Complaint" means the written statement <br />(prepared by the Manager, if based on oral statements made by <br />members of the public or owners or occupants of property) made by <br />members of the public, owners or occupants of properties served <br />by Company, or officers, employees or agents of Agency or <br />Authority alleging non-performance or deficiencies in performance <br />of Company's duties and obligations under this agreement, or <br />otherwise alleging a violation by Company of the provisions of <br />this agreement including, but not limited to, failure of Company' <br />to comply with the requirements of Sections 5.2-5.7, inclusive, <br />the filing of which Complaint commences enforcement proceedings <br />pursuant to Article VIII hereof. <br /> <br /> 3 <br /> <br /> <br />
