Section 1.10. "Containers" means any and all types of Solid <br />Waste receptacles including, but not limited to Bins, cylindrical <br />containers commonly available at retail for residential use, and <br />any and all other kinds of receptacles, irrespective of size or <br />shape. <br /> <br /> Section t.11. "Governing Body" means the Board of <br />Supervisors, City Council, or Board of Directors (as the case may <br />be), the legislative body of Agency. <br /> <br /> Section 1.12. "Hazardous Waste" means such waste as defined <br />in Section 66714.8 of the Government Code of the State of <br />California (as said Section exists upon the date hereof, or from <br />time to time may be amended, revised, or superseded) which for <br />the purpose of this agreement shall include toxic waste. <br /> <br /> Section 1.13. "Manager" means Agency's Chief Executive <br />Officer, howsoever designated by Agency, and his or her designee. <br /> <br /> Section 1.14. "Operating Costs" means any or all costs <br />properly allocable to the performance and operation of the <br />exclusive franchise granted herein for the purpose of the rate <br />modification process described in Article VI, the categories of <br /> <br />which are specified in Company's chart of accounts set forth in <br /> ? <br />Exhibit "A" hereof (entitled, "SBTSA Solid Waste Collection Rate <br /> <br />Review Manual" dated August 1987) attached hereto and <br />incorporated herein. <br /> <br /> Section 1.15. "Operating Year" means the 12-month period <br />commencing upon October 1, 1987, and each successive 12-month <br />period thereafter throughout the term hereof. <br /> <br /> Section 1.16.
