DES:djk 08/31/87R <br /> <br /> Company shall report to Agency, on such written forms as <br />Agency, or Authority on behalf of Agency, may approve, the number <br />and nature of complaints received by, or reported to, Company <br />following each three-month period during each Operating Year. <br />Said reports shall also include a description of such remedial <br />action as may have been taken by Company in response to such <br />complaints or, if such action has not been taken, an explanation <br />therefor. <br /> <br /> Section 5.7. Damage to Property. Company shall endeavor to <br />resolve all claims as soon as reasonably practicable following <br />receipt thereof, made by owners or occupants of property served <br />by Company, for damages to property including, but not limited <br />to, Containers. In the event such damage shall have been caused <br />by the negligence or intentional acts of Company, its officers, <br />agents, or employees, Company shall promptly repair or replace <br />such damaged property. The provisions of this section shall not <br />be deemed a limitation upon the provisions of any other section <br />hereof including, but not limited to, Sections 7.1 (Performance <br />Bond), 7.2 (Indemnification), 7.3 (Insurance), or Article VIII <br />(Enforcement), or any rights or remedies which may accrue to <br />Agency by reason of Company's acts or omissions to act hereunder. <br /> <br /> Section 5.8. Grounds For Enforcement. Failure to comply <br />with the standards and procedures implemented pursuant to Section <br />5.1, or with the requirements of Sections 5.2, 5.3, 5.4, 5.6, and <br />5.7, shall be grounds for issuance of a Compliance Order, <br />Termination Order or Order for Payment of Compensatory Damages <br />pursuant to the provisions of Article VIII; provided, that <br />nothing contained herein shall be deemed a limitation upon <br />19 <br /> <br /> <br />
