A. The proceeds of its sales of Recyclable Materials, <br /> <br />plus <br /> <br /> B. A surcharge (hereinafter "Surcharge") equal to <br /> <br />three and one-half percent (3%%)-of the rates for Collection <br />of Solid Waste as provided in the Uniform Collection <br />Agreement, separately itemized and identified on the <br />Billings of Company as a charge for Recycling Services. <br /> <br /> The Surcharge hereby established shall be exclusive of <br />any franchise fee which may be subsequently imposed by <br />Agency, and any contract administration expense incurred by <br />Company at the direction of Agency or Authority. Both of <br />the foregoing shall be accounted for as an adjustment to the <br />Surcharge at such time as Company and Agency shall agree. <br /> <br /> Company may file an application for Surcharge increase <br />in the event the cumulative operating ratio exceeds <br />ninety-one percent (91%) subject to the following <br />limitations: <br /> <br /> (1) Company may file no more than one (1) <br /> application for Surcharge increase in any twelve (12) <br /> month period; <br /> <br /> (2) No application for Surcharge increase may <br />exceed ten percent (10%) of the existing Surcharge for <br />collection of Recyclable Materials. <br />There shall be no change in the Surcharge except as provided <br />in this Section. <br /> <br /> <br />
