1 ARTICLE I <br />2 EXISTING AGREEMENTS <br /> <br />3 1.1 Relationship to Uniform Franchise Agreement. Agreement for Collection of <br />4 Recyclable Materials. and the Memorandum of Understanding and <br />5 Clarification <br />6 Agency and Company intend this Agreement to operate and to be interpreted as <br />7 a separate Agreement from both the Uniform Franchise Agreement, entered by <br />8 Agency and Company effective October 1, 1987, and the Agreement for <br />9 Collection of Recyclable Materials, entered by Agency and Company effective <br />10 August 25, 1988, and the Memorandum of Understanding and Clarification, <br />11 entered by Agency and Company effective June 22, 1982. <br /> <br />12 1.2 Impact on Recycling Agreement <br />13 This Agreement and the separate Agreement for Collection of Recyclable <br />14 Materials are to be viewed as complimentary agreements. Nothing in one <br />15 agreement supersedes the other, unless so stated. Both agreements are designed <br />16 to assist Agency in achieving its fifty percent (50%) diversion goal by the year <br />17 2000. The primary interaction between these two agreements is that together they <br />18 allow for the creation of Environmental Day, as described in Section 4.2.3. <br /> <br />19 1.3 Integration of Services <br />20 This Agreement, the Uniform Franchise Agreement, the Agreement for <br />21 Collection of Recyclable Materials, and the Memorandum of Understanding and <br />22 Clarification, are entered into and shall be interpreted as separate agreements; <br />23 notwithstanding, the termination of anyone agreement by either party shall <br />24 constitute the te~£,tination of all agreements. <br /> <br /> Page 3 8/2/96 <br /> <br /> <br />
