1 2.7 California Inte_~rated Waste Mana_~ement Act of 1989 <br /> 2 "California Integrated Waste Management Act of 1989" means (California Public <br /> 3 Resources Code, §40,000 et. seq.). <br /> <br /> 4 2.8 Commercially Generated Recyclable Materials <br /> 5 "Commercially Generated Recyclable Materials" means Recyclable Materials <br /> 6 · generated at commercial and/or industrial property and separated by the Waste <br /> 7 Generator for Collection in a manner different from Solid Waste. Commercially <br /> 8 Generated Recyclable Materials are excluded from the scope of this Agreement <br /> 9 as described in Section 3.7. <br /> <br />10 2.9 Company <br />11 "Company" means Browning-Ferris Industries, Inc. of San Mateo County, a <br />12 corporation organized and operating under the laws of the State of California, <br />13 and its officers, directors, employees, agents, companies, and subcontractors <br />14 where applicable. <br /> <br />15 2.10 Compan.v's Proposal <br />16 "Company's Proposal" means the proposal submitted by Company and received <br />17 by Agency on August 15, 1994 (included as Exhibit ! to this Agreement), as <br />18 amended by Company on March 28, 1995 Amendments (included as Exhibit 2) <br />19 and proposal dated July 12, 1996 (included as Exhibit 3). Proposals are <br />20 incorporated by reference. <br /> <br />21 2.11 Complaint <br />22 "Complaint" means the written statement (prepared by the Manager, if based on <br />23 oral statements made by members of the public or owners or occupants of <br />24 property) made by members of the public, owners or occupants of properties <br />25 served by Company, or officers, employees or agents of Agency or Authority <br />26 alleging non-perfom-tance or deficiencies in perfom-tance of Company's duties <br />27 and obligations under this Agreement, or otherwise alleging a violation by <br />28 Company of the provisions of this Agreement, including, but not limited to, <br />29 failure of Company to comply with the requirements of Section 5.2.3. <br /> <br /> Page5 8/2/96 <br /> <br /> <br />
