se~_.: the Safe Drinking Water and Toxic Enforcement Act, California Health and <br /> Safety Code §25249.5 et. se~.: as currently in force or as hereafter amended, and <br /> all rules and regulations promulgated thereunder. <br /> <br /> 4 2.18 Fiscal Year <br /> 5 "Fiscal Year" means the period commencing July 1 of one year and concluding <br /> 6 June 30 for Agency. <br /> <br />7 2.19 Full Regulatory. Compliance <br />8 "Full Regulatory Compliance" means compliance with all applicable pet-ii-tits for <br />9 any facility utilized by Company, such that the Company will at all times <br />10 maintain the ability to fully comply with its obligations under this Agreement. <br /> <br />11 2.20 Green Waste <br />12 "Green Waste" means a subset of organic Recyclable Materials consisting of <br />13 grass cuttings, weeds, leaves, prunings, branches, dead plants, brush, tree <br />14 trimmings, dead trees (not more than six (6) inches in diameter), and similar <br />15 materials generated at residential properties within Agency, separated and set <br />16 out for Collection, processing, and Recycling. Green Waste does not include <br />17 materials not normally produced from gardens or landscapes, such as, but not <br />18 limited to, palm fronds, brick, rock, gravel, large quantities of dirt, concrete, sod, <br />19 non-organic wastes, oil, and wood or wood products. Diseased plants and trees <br />20 are also excluded from Green Waste. <br /> <br />21 2.21 Green Waste Container <br />22 "Green Waste Container" means a Container of size, type, and construction <br />23 appropriate for use by residents to hold Green Waste until Collected by <br />24 Company. Green Waste Containers may be no larger than forty-five (45) gallons <br />25 in size, nor weigh more than sixty (60) pounds when full. <br /> <br />26 2.22 Hazardous Waste <br />27 "Hazardous Waste" means all substances defined as Hazardous Waste, acutely <br />28 Hazardous Waste, or extremely Hazardous Waste by the State of California in <br />29 Health and Safety Code §25110.02, §25115, and §25117 or in the future <br />30 amendments to or recodifications of such statutes or identified and listed as <br />31 Hazardous Waste by the U.S. Environmental Protection Agency, pursuant to the <br /> <br /> Page 7 8/2/96 <br /> <br /> <br />
