1 be provided under this Agreement, or the person holding legal title to a facility <br /> 2 utilized by Company under this Agreement. <br /> <br /> 3 2.29 Processin_~ Facili.ty <br /> 4 "Processing Facility" means a facility in Full Regulatory Compliance where <br /> 5 Green Waste is sorted or separated for the purposes of Recycling, reuse or <br /> 6 compostingl <br /> <br /> 7 2.30 Rate Year <br /> 8 "Rate Year" means the period from January ! through December of each year of <br /> 9 the term of the Agreement. <br /> <br />10 2.31 Recyclable Materials <br />11 "Recyclable Materials" means those materials that are offered for collection and <br />12 which are non-hazardous domestic, commercial, or industrial by-products of <br />13 some potential economic value, set aside, handled, packaged, or offered for <br />14 Collection in a manner different from garbage or refuse. <br /> <br />15 2.32 Recycled <br />16 "Recycled" means the act of having processed Recyclable Materials into a form <br />17 suitable for reuse and having marketed those processed materials for a use <br />18 consistent with the requirements of the California Integrated Waste Management <br />19 Act of 1989 for Recycled materials. The act of marketing does not require that <br />20 revenue is generated from the processed materials. <br /> <br />21 2.33 Recyclin_~ <br />22 "Recycling" means the process of separating for Collection, Collecting, treating <br />23 and/or reconstituting Recyclable Materials or Green Waste which would <br />24 otherwise be discarded without receiving compensation or returning them to the <br />25 economy in the form of raw materials for new, reused, or reconstituted products. <br />26 The Collection, transfer, transportation, or Disposal of Solid Waste not intended <br />27 for, or capable of, reuse is not Recycling. Recycling does not include use of Solid <br />28 Waste for conversion to energy. This definition supersedes that provided in the <br />29 Agreement for Collection of Recyclable Materials. <br /> <br /> Page9 8/2/96 <br /> <br /> <br />
