refuse to Collect Green Waste from, and shall not be obligated to continue to <br /> provide any Green Waste Container to, any Customer who, after reasonable <br /> warning, fails to sort Green Waste from other Solid Waste and/or fails to set out <br /> properly their Green Waste Container. <br /> Company may not Collect Green Waste that contains three percent (3%) by <br /> volume or greater of Solid Waste. Company shall report monthly to Agency any <br /> warning notices issued. <br /> <br />8 4.2.8 Collection of Self-Haul Green Waste <br />9 Company shall accept all Green Waste generated within Agency's geographic <br />10 boundaries and Self-Hauled to a Composting or Materials Recovery Facility <br />11 designated by Company. Company shall divert Self-Haul Green Waste as part of <br />12 Agency's diversion program goals of fifty percent (50%). <br /> <br />13 4.2.9 End Uses for Green Waste <br />14 Company agrees to develop, implement, operate, and participate (locally and <br />15 regionally) in mulching, composting, alternative daily cover, transformation, or <br />16 other programs necessary to achieve Agency's Green Waste diversion <br />17 requirements, in accordance with Company's Proposal (Exhibits 1, 2 and 3). <br />18 Company must provide end uses for Green Waste that maximize diversion <br />19 credits according to regulations established by the California Integrated Waste <br />20 Management Board. Company shall make end products (compost or mulch) <br />21 available to Agency residents at a cost to residents to be determined by the <br />22 Agency. Company may utilize Green Waste as alternate daily cover to the extent <br />23 allowed by prevailing law. <br />24 Company agrees to accomplish the programs set out in this Agreement and to be <br />25 aggressive in the pursuit of new cost-effective opportunities to divert Green <br />26 Waste from Disposal, and to maximize the distribution of Green Waste among <br />27 approved diversion methods. To the extent allowed under existing law, <br />28 Company intends to use alternative daily cover at its Ox Mountain Landfill for <br />29 full diversion credits, as specified in Company's Proposal (Exhibits 1, 2 and 3). <br />30 Should prevailing law preclude the use of alternative daily cover in landfill sites <br />31 for diversion credits, or should Company be unable to obtain a permit for such <br />32 application, Company and neither the rate payers nor the Agency shall accept <br />33 full responsibility, financial and otherwise, for establishing alternate diversion of <br />34 Green Waste that will fully qualify for diversion credits. <br /> <br /> Page 21 8/2/96 <br /> <br /> <br />
