1 4.2.10 Marketing and Sale of Green Waste Materials <br />2 Company shall be responsible for marketing and sale of all Green Waste <br />3 Collected pursuant to this Agreement. Revenues from the sales of these materials <br />4 shall be applied to the cost of services under the Agreement to reduce <br />5 Company's Compensation. Company shall sell at not less than fair market value <br />6 all Green Waste that is Collected, but not made available to Agency residents, <br />7 pursuant to this Agreement. <br />8 Company shall prepare, submit to the Agency for approval, and maintain a <br />9 marketing plan for all Green Waste Collected by Company under this <br />10 Agreement. The approved marketing plan shall be in place with the execution of <br />11 this Agreement for proposed Green Waste service and at the time of beginning <br />12 any expanded service. The marketing plan shall fully describe Company's <br />13 marketing methods and approach, targeted primary and contingent markets, <br />14 pricing policy, and assumed salvage value for each Collected type of Green <br />15 Waste. <br /> <br />16 4.3 Operations <br />17 4.3;1 Collection Schedules <br />18 Company agrees that to preserve peace and quiet, it will limit Collection of <br />19 Green Waste from or within two-hundred (200) feet of residential premises to the <br />20 hours of 6:00 A.M. through 6:00 P.M., Monday through Friday, except that <br />21 Company may Collect missed Friday Collections on the following Saturday, <br />22 between the same hours, as provided below. <br />23 The Company shall guarantee complete Curbside Green Waste Collection service <br />24 on each route on each day of Collection service. As specified in Article X of this <br />25 Agreement, Agency may assess liquidated damages on Company for failure to <br />26 collect Green Waste that has been properly set out for Collection. In the event of <br />27 a call-in missed pick up, Company shall Collect the Green Waste within one (1) <br />28 day (24 hours) of report of a missed pick-up. Collections missed and reported to <br />29 Company on Friday will be picked up on that Friday or the following Saturday. <br /> <br />30 4.3.2 Vehicles <br />31 A. General. Company shall provide a fleet of Collection vehicles as described in <br />32 Company's Proposal (Exhibits 1, 2 and 3). The vehicles shall be sufficient in <br />33 number and capacity to perform the work required by the Agreement in strict <br />34 accordance with its terms.
