1 6.3 Company's Initial Rates <br /> 2 Agency's approved initial rate for Green Waste services provided under this <br /> 3 Agreement is attached as Exhibit 4. <br /> <br />4 6.4 Subsequent Rates <br />5 Except that no adjustments shall be made to reflect the addition of collection <br />6 personnel or vehicles for services under this Agreement, rate modifications will <br />7 be made in the same manner and form as provided in the Uniform Franchise <br />8 Agreement, Sections 6.2-6.7, inclusive, and the Memorandum of Understanding <br />9 and Clarification dated June, 1982, as amended. For purposes of deters,Lining the <br />10 reasonableness of processing costs, the current processing cost of $24 per ton <br />11 charged at the Newby Island Composting Facility shall not be increased by <br />12 greater than the annual percentage change in the San Francisco-Oakland- <br />13 Metropolitan Area Consumer Price Index (Urban Consumers; 1982-84=100) for <br />14 the twelve months immediately preceding the submission of the Company's rate <br />15 application. Should governmental fees be applied or subsequent to their <br />16 application be increased at the Newby Island Composting Facility, the Parties <br />17 shall meet to evaluate whether use of this facility or another facility is cost <br />18 effective and Agency shall determine whether to continue use of the Newby <br />19 Island Composting Facility or whether the Green Waste collected under this <br />20 Agreement shall be processed elsewhere. <br />21 Company will separately account for all revenues and expenses related to the <br />22 services provided under this Agreement, thereby assisting the rate application <br />23 and review process. <br /> <br /> Page 36 8/2/96 <br /> <br /> <br />
