in which said payments are received in the same proportion as <br />the last succeeding payment of maintenance and operation costs <br />charged to the cities. <br />Section 1.7, Arbitration <br />All controversies arising out of the interpretation or <br />application of this agreement or the refusal of any city to <br />per -form the whole or any part thereof shall be settled by <br />arbitration inaccordancewith the provisions of this section. <br />The controversy shall be submitted to a board (the "board") <br />of arbitrators, one of which shall be appointed by each of the <br />cities. The City desiring arbitration shall notify the other <br />cities by a written notice stating the following; <br />1) That it desires arbitration. <br />2) The controversy to be arbitrated. <br />3) That it has appointed its nominee, and <br />4) tha' , it requests the other cities to appoint their <br />nominees. <br />Each other city shall, within thirty (30) days from the receipt <br />of said notice, so notify the other cities and appoint its <br />arbitrators, None of the arbitrators 5;hall be a resident of or <br />taxpayer -in, or own property in, or have a place of business <br />in, or be an officer or employee of, any of the cities. The <br />board shall hold at least one hearing and at least ten (10) <br />days before said hearing shall give each city written notice <br />thereof. The arbitration shall be restricted to matters relative <br />to that stated in the notice requesting arbitration. Each city <br />shall be given an opportunity to be heard and to presci-it evidence. <br />Upon conclusion of the hearing or hearings the board shall state <br />its findings of -fact, conclusions of law and decision in writing, <br />and shall sign the same and deliver one signed copy thereof to <br />each city.
