Closed files transferred to CMI for storage at the commencement of this <br />Agreement will be stored at the City's expense. The charge for file box storage will be <br />the greater of $.75 or our current cost per box of files per month. The first year of <br />storage will be paid in advance within thirty (30) days of the signing of this Agreement. <br />X. TRUST AGREEMENT <br />City will establish an account for the payment of all liability incurred under the <br />terms of this Agreement. The account shall be funded adequately to pay all <br />expenditures. Funding of account and reconciliation will be as agreed upon between <br />City and CM I. <br />XI. INSURANCE AND INDEMNIFICATION <br />CMI shall indemnify and save harmless City from and against all losses and all <br />claims, demands, payments, suits, actions, recoveries, and judgments of every nature <br />and description brought or recovered against it, by reason of any act or omission of <br />CMI, its agents or employees, in the execution of the service or in consequences of any <br />negligence or carelessness of the same and shall provide an Errors and Omissions <br />policy in the amount of $1 ,000,000 to assure that City will be protected from any errors <br />and omissions resulting from the work of CM!. <br />Before performing services CMI will provide evidence of the following insurance <br />coverages: <br />1.
